دور برامج التنمية في دعم وظيفية الضبط الإداري المحلي - رؤية جديدة للنظام العمومي في الجزائر-

Abstract

تماشيا مع السياسات الحديثة المرتكزة على تكريس مظاهر الحكم الراشد في مختلف مجالات تسيير الشأن العمومي، فقد اعتمدت أغلب الدول في صيانة نظامها العمومي على المقاربة التنموية كداعم أساسي للآلية التقليدية المتمثلة في وظيفة الضبط الإداري. وانطلاقا من هذا التحول القائم على تضييق مجال السياسات الضبطية، في مقابل توسيع اللجوء إلى السياسات التنموية المثبطة لمختلف الإخلالات الماسة بالاستقرار المجتمعي في الدولة لا سيما على المستوى المحلي، فقد اتجهت الجزائر إلى تطوير سياساتها الهادفة إلى الحفاظ على النظام العمومي من خلال تزويد السلطات الإدارية المحلية المخولة بالحفاظ على النظام العمومي، بآليات تنموية-برامج تنموية ذات مصادر تمويل مختلفة-مُدعِمة للآليات التقليدية المحصورة في الوسائل القانونية لممارسة وظيفة الضبط الإداري. ستحاول هذه الورقة البحثية الإجابة على الإشكالية المتمثلة في مدى إمكانية توظيف البرامج التنموية كآلية داعمة لوظيفة الضبط الإداري من أجل الحفاظ على النظام العمومي على المستوى المحلي في الجزائر، من خلال توضيح ملامح كل من وظيفة الضبط الإداري والوظيفة التنموية على المستوى المحلي، بالإضافة لبيان معالم التكامل بين هاتين الآليتين الهادفتين للحفاظ على النظام العمومي، وصولا لاستخلاص نتائـج وتسجيل اقتراحات تساعد في تحقيق التوازن المنشود بين فكرتي النظام العمومي والحريات العامة في الجزائر. In line with recent policies based on the promotion of good governance in various areas of public administration, most States have relied in maintaining their public order on a developmental approach as an essential supporter of the traditional mechanism of administrative police. On the basis of this shift of narrowing the scope of disciplinary policies, as opposed to expanding the use of development policies that discourage various disruptions to the State's social stability, particularly at the local level, Algeria has been developing its policies aimed at maintaining public order by providing local administrative authorities empowered to maintain public order with development mechanisms.-Development programmes with different sources of funding, supported by traditional mechanisms confined to the legal means of exercising the function of administrative police. This paper will try to answer the problem of the extent to which development programmes can be used as a supporting mechanism of administrative police. function in order to maintain the public order at the local level in Algeria by clarifying the features of the administrative police function. and development functions at the local level, in addition to indicating the complementarity between these two mechanisms aimed at maintaining public order, in order to draw conclusions and record proposals aimed at developing a basis for a complementary relationship between these two variables in order to achieve the desired balance between the ideas of public order and public freedoms in Algeria.
