المركز الدستوري للمحكمة الدستورية وعلاقتها بالسلطات الثلاث في ظل دستور 2020

Abstract

لقد تم إنشاء المحكمة الدستورية بموجب التعديل الدستوري لسنة 2020 والمحددة كذلك في عنوان الباب الرابع المخصص لمؤسسات الرقابة وتعد هيئة دستورية مستقلة عن باقي السلطات وحددت قواعد تشكيلها وتنظيم عملها وفقا للدستور والقانون العضوي .إن مهام المحكمة الدستورية تتكامل مع مهام السلطات الثلاثة، التنفيذية والتشريعية والقضائية، التي جميعها تطمح في بناء دولة القانون والمؤسسات الراعية لحقوق الإنسان والحريات العامة، غير أن فعالية المحكمة الدستورية مرهون بموقعها وعلاقتها ضمن السلطات الثلاثة، ومدى تأثيرها عليها من خلال تشكيلتها واستقلالية أعضائها وآليات عملها ومجالات الرقابة التي تمارسها على السلطات الثلاثة المحددة ضمن أحكام الدستور، وهو ما سوف نتناوله في هده الدراسة بالشرح موقع المحكمة الدستورية في النظام الدستوري الجزائري لنستطيع فهم طبيعة العلاقة التي تربط هيكل القضاء الدستوري بالسلطات الثلاثة. The Constitutional Court was established under the 2020 constitutional amendment, as outlined in Title IV, which is dedicated to oversight institutions. It is an independent constitutional body, separate from the other branches of power, with its composition and operational rules defined by the Constitution and the organic law. The role of the Constitutional Court is intrinsically linked to the functions of the three branches of government—executive, legislative, and judicial—all of which aspire to build a state governed by the rule of law and institutions that safeguard human rights and public freedoms. However, the effectiveness of the Constitutional Court depends on its position and relationship within the institutional framework, as well as its influence on the three branches of power. This influence is shaped by its composition, the independence of its members, its working mechanisms, and the scope of its oversight as defined by constitutional provisions. This study will analyze the position of the Constitutional Court within the Algerian constitutional system to better understand the nature of its relationship with the three of power.
