آثـار حــوادث الطـرقـات على صحـة الفـرد النفسيـة

قد ينتج عن الحوادث المرورية صدمات نفسية للمصابين وهي لا تقتصر على مرتكب الحادث بل تمتد إلى مرافقيه وأسرهم جميعاً وحتى من يشاهد الحادث. وقد تظهر أعراض هذه الاضطرابات بعد عدة أسابيع من الإصابة بالصدمة أو عدة شهور أو سنوات حسب ظروف كل حالة على حدا، وهو ما سأقوم بدراسته من خلال هذا البحث، بالتركيز على أهم الآثار النفسية لحوادث المرور. Traffic accidents may result in psychological shocks to the injured and are not limited to the perpetrator of the accident, but can extends to his companions and their families and even everyone who sees the incident. Symptoms of these psychoses may appear several weeks after the shock, or several months or years depending on the circumstances of each case That’s what i will to study in this search, by focusing on the most important psychological effects of the accidents
أثـر تعديـل قانون المـرور الجزائري رقم 17/05 على واقـع ظاهرة حـوادث الطرقات

تمثل ظاهرة حوادث الطرقات مشكلا، وهاجسا مخيفا بالنسبة لمستعملي الطرقات في الجزائر، نظرا لما تخلفه من أرقام مخيفة في الخسائر المادية، والبشرية. ونظرا لأن مشكلة الحوادث المرورية لها علاقة بالقوانين والتشريعات المتعلقة بتنظيم حركة المرور فإن الدولة الجزائرية لم تدخر أدنى جهد في البحث عن أسباب الظاهرة، ومواجهتها بسن النصوص القانونية التي تراها مناسبة من حيث الزمان، والمكان لتحقيق السلامة المرورية، حيث جاء التعديل الأخير لقانون المرور رقم 17/05 للتقليل من حدة الظاهرة. وجاءت هذه الدراسة كقراءة تحليلية لأهم أحكامه سعيا إلى تبيان الفجوة الموجودة بين النصوص القانونية، والواقع المعاش. The phenomenon of road accidents is a problem and a frightening cocren for the road in algeria, because of the frightening figures in the material and human losses. Since the problem of traffic accidents has to do with the laws and the traffic laws, the algerian state has spared no effort in searching for the causes of the phenomenon and facing them by enacting the legal texts it deems appropriate in terms of time and place to achieve traffic safety no.17/05 to reduce the severity of this phenomenon. And this study came as an analytical reading of the most important provision in order to show the gap between the legal texts and the reality of the pension.
أثر تقنية البصمة الوراثية على الاقتناع الشخصي للقاضي الجزائي على ضوء القانون الجزائري والمقارن

يعتبر موضوع الإثبات الجنائي من المواضيع التي اهتم بها فقهاء القانون الجنائي ولا زال هذا الاهتمام الي يومنا هذا نظرا لما لهذا الميدان من أهمية وحساسية تتعلق بموضوع الجريمة نفسها أو احد أطرافها وما في ذلك من مساس بالحريات والحقوق الفردية للأشخاص، كما تشير الكثير من الشواهد العلمية الحديثة إلى ان المجتمعات الإنسانية تشهد الي جانب الانفجار المعلوماتي والمعرفي، ثورات علمية في الجانب الإحيائي والبيولوجي أحدثت تغيرات جذرية وخطيرة أنعكست علي كافة نواحي الحياة. ومن أهم ما أبرزه التطور في علم الأحياء هي الثورة المعرفية في علم الوراثة وإكتشاف ما يسمى بالبصمة الوراثية وما خلفته من إنعكاسات علي مختلف مجالات الحياة، حيث تم الإستفادة منها في كثير من المجالات، من أهمها ميدان الإثبات الجنائي، وذلك لما له من أهمية ودور في كشف ملابسات الجرائم وتقديم المتورطين فيها الي العدالة وتنويرها لإصدار الحكم الصواب وكذا لإرتباطه الوثيق بحرمة وقداسة الجسم البشري، وهو العامل الذي حفزني لتناول هذا الموضوع بالبحث والمعنون بــ: أثر تقنية البصمة الوراثية على الاقتناع الشخصي للقاضي الجزائي على ضوء القانون الجزائري والمقارن، مستهدفا من وراء ذلك التطرق الي مدى تأثير البصمة الوراثية كدليل علمي في تكوين وتشكيل الإقتناع الشخصي للقاضي الجزائي. The subject of criminal evidence is one of the topics that have been raised by the jurists of criminal law and are still today because of the importance and sensitivity of this field to the crime itself or one of its parties and the violation of freedoms and individual rights, as many recent scientific evidence indicates that human societies are witnessing Alongside the explosion of information and knowledge, scientific revolutions in the biological and biological side have caused radical and dangerous changes that have been reflected in all aspects of life. One of the most important developments in biology is the knowledge revolution in genetics and the discovery of so- called genetic fingerprint and its implications on various areas of life, which has been used in many fields, whichever field of criminal evidence, because of its importance And a role in uncovering the circumstances of the crimes and bringing those involved to justice and enlighten them to make the right judgment as well as its close association with the sanctity and holiness of the human body, which motivated me to address this subject research and entitled: DNA and its role in the formation of personal conviction of the criminal judge, The impact of DNA as a scientific evidence in the composition of the criminal judge.
إستـراتيجيــة الاتحــاد الأوروبـي - الفـرنسـي للأمــن والتنميــة فـي منطقــة الساحــل الإفـريقي

يناقش هذا المقال الدور الأوروبي في منطقة الساحل من خلال إستراتيجية الاتحاد الأوروبي للأمن والتنمية في الساحل الإفريقي، من خلال التطرق إلى محتوى وآليات تنفيذ هذه الإستراتيجية وتأثيرها على الأمن والاستقرار في منطقة الساحل، مع التطرق للمنظور الفرنسي لهذه الإستراتيجية حيث تعيش فرنسا تخبطا في سلوكها الخارجي إزاء الساحل بين محاولة إحياء إرثها الكولونيالي أو لبس عباءة الاتحاد الأوربي بحثا عن الشرعية والمسوغات الرسمية والشعبية لدعم التدخل، في ظل المزاحمة الصينية ومصالح القوى النامية هنا وهناك.this article discusses the european role in the coast region through the strategy of the european union for peace and development in the african coast by approaching the content and the mechanisms used to apply the main strategy and it's influence on security and stability in the coast region including the french perspective of this strategy where france is living a confusion in it's external behavior toards the coast in an attempt to either revival it's clonial heritage or wear the cloack of the europien union in search for legitimacy also formal and informal drafts to support it's intrferance in the light of the chinese concurent and the interests of developing powers here and there
الإحتكار الصيدلاني الإلكتروني ودوره في حماية المستهلك

تعد التجارة الإلكترونية من أهم التطورات المستخدمة في إنعاش النشاط الإقتصادي الوطني والدولي على حد سواء، حيث ومن خلال إستغلال شبكة الأنترنت كأداة للتسويق الإلكتروني تمكنت العقود الإستهلاكية الإلكترونية من أن تحتل مكانة هامة في حياة الفرد مقارنة بالعقود التقليدية التي مكنت المستهلك من تلبية حاجاته الشخصية بما فيها المنتجات الصيدلانية التي عرفت رواجا منقطع النظير. هذا النوع من العقود الإلكترونية تشكل في الواقع خطرا حقيقيا على صحة المستهلك الذي تنقصه المعرفة التقنية بهذا النوع من المنتوجات، وعلى هذا الأساس لابد من تفعيل مبدأ الإحتكار الصيدلاني في البيئة الإلكترونية بهدف التقليل من آثار ظاهرة الصيدليات الإلكترونية غير القانونية حماية للمستهلك بالدرجة الأولى.
الاسـاءة لصـورة الاســلام والمسلمين فـي الاعـلام الغربي: المنطـلقات والمضاميـن

يرمي هذا الجهد البحثي المتواضع، إلى استجلاء أهم البواعث الكامنة وراء حملات الاعلام الغربي لتشويه صورة الاسلام والمسلمين، وتفحص المنطلقات الثقافية والسياسية والاستراتيجية التي تقف وراء المخطط الاعلامي الغربي الذي يستهدف ترسيخ صورة نمطية بشعة للاسلام في ذهن المتلقي الغربي والعالمي. وتم الخلوص، إلى أن الصورة المشوهة التي باتت لصيقة بكل مايمت للاسلام بصلة، ماهي إلى جزء من مخطط وحرب إعلامية نفسية شاملة تستهدف العالم الاسلامي وترمي إلى السيطرة عليه. كما تستهدف الاسلام كدين واسلوب حياة، يرى قطاع كبير من صناع الرأي والفكر في الغرب انه بات تهديدا خطيرا لقيمهم وأسلوب حياته. The goal of this research effort,is to elucidate the most important motives behind the Western media campaigns to tarnish the image of Islam and Muslims, and examine the cultural, political and strategic perspectives behind that Western media plan, which aims to establish hatered of Islam in the minds of western and world public opinion. we conclude that the distorted image of Islam, psychological warfare, media comprehensive targeting the Islamic world and designed to control it. As targeting Islam as a religion and a way of life, a large segment of Thought and opinion makers see that islam has become a serious threat to the values of the West and his life style.
الاطـار الـدستـوري وعمليـة الانتقـال الـديمقـراطي فـي المغـرب

يعتبر المدخل الدستورى من أهم مؤشرات الانتقال الديمقراطي، فالتعاقد الدستورى يحدد المؤسسات الرسمية للنظام السياسي، ويقوم بتوزيع الصلاحيات بينها، كما يحدد العلاقة بينها بطريقة تضمن اعادة تشكيل الجانب السياسي . وإدراكا من فواعل الحقل السياسي المغربي بأهمية مدخل الاصلاح الدستورى في عملية الانتقال الديمقراطي، اتفقت على منحه الاولوية في قائمة الاصلاحات، وتم الاخذ بجملة من المراجعات الدستورية في عام 1992، 1996، 2011 . وعليه سنتناول هذه المراجعات الدستورية بالدارسة لمعرفة مدى مساهمتها في تحقيق انتقال ديمقراطي فعلي في المغرب من خلال تناول توزيع الصلاحيات بين السلطات الثلاث، وكذا العلاقة بينها ومدى تكريس مبدأ الفصل بين السلط . Abstract: The constitutional approach is one of the most important indicators of democratic transition, The constitutional contract defines the official institutions of the political system, distributes the Functions and defines the relationship between them to ensure the restructuring of the political side. With knowing the importance of the introduction of constitutional reform in the process of democratic transition , Moroccan political parties system gave priority to the constitutional entry and adopted a séries of constitutional révisions in the years 1992, 1996 and 2011. Therefore , the discussion of thèse constitutional révisions Will show how it contributes to an équitable distribution of Functions between the institutions of the Moroccan political system in accordance with the principale of séparation of powers inorder to achieve a génuine democratic transition in Morocco.
الإطـار القانـوني للفتـرة الأمنيـة فـي التشريع الجــزائـري

يعد نظام الفترة الأمنية من أهم الأنظمة التي تحقق الردع والعدالة، ولقد أقر المشرع الجزائري تطبيق الفترة الأمنية فهي حرمان المحكوم عليه من تدابير التوقيف المؤقت لتطبيق العقوبة والوضع في الورشات الخارجية أو البيئة المفتوحة وإجازات الخروج والحرية النصفية والإفراج المشروط، والفترة الأمنية نوعان إجبارية وتطبق بقوة القانون، وإختيارية حيث أن لجهة الحكم السلطة التقديرية في تطبيقها، وتطبق في حالة إرتكاب الشخص لجناية أو جنحة والحكم بعقوبة سالبة للحرية تساوي أو تزيد عن مدة معينة.The security period is one of the most important systems wich achieve deterrence and justice, and The algerian legislator has approved the implementation of the security period, it is the depruvaton of the sentenced from the tamporary detention measures to apply the sentence and the situation in external workshops or open environment and exit leave and half freedom and parole, situation in external workshops or open environment and exit leave and half freedom and parole, the are two types, mandatory lawfully enforced and optional the judge has discretion in applying them, and applied in the case of a felony or misdemeanor and a penalty of deprivation of liberty equal to or exceeding a certain period.
الإطار القانوني والمؤسساتي لقطاع الطاقات المتجددة فـي الجزائر

تمثل الطاقات المتجددة أهم المصادر الرئيسية للطاقة العالمية خارج النفط، فضلا عن كونها طاقة نظيفة وغير ملوثة للبيئة ما يكسبها أهمية لتحقيق التنمية المستدامة، وتهدف هذه الدراسة إلى معرفة واقع مجهودات الحكومة الجزائرية في مجال الطاقة المتجددة، وتبيان مدى أهمية الطاقات المتجددة في الجزائر، كونها تعتبر احد أبرز الدول المرشحة للعب دور رئيسي ومهم في معادلة الطاقة، نظرا لامتلاكها مصادر طبيعية هائلة في مجال إنتاج الطاقات البديلة، وإبراز مختلف أثار تطوير استخدام هذه الطاقات المتجددة على الاقتصاد الوطني. Renewable energies represent the main sources of global energy outside of oil, as well as being clean and non-polluting energy. This study aims to know the Algerian government's efforts in the field of renewable energy and the importance of renewable energies in Algeria. One of the most important candidate countries to play a major role in the energy equation, because it has huge natural resources in the field of alternative energy production, and highlight the various effects of the development of the use of these renewable energies to the national economy.
الإطار الناظم للرقابة الدستورية دراسة مقارنة بين الجزائر وتونس

لقد أوكل الدستور الجزائري للمجلس الدستوري مهمة الرقابة على دستورية القوانين مهما كان شكلها، حيث يعتبر هذا المجلس من مستحدثات دستور1989، الأمر الذي يجعله محل آمال الكثير في أن يكون حصنا منيعا لحماية الحقوق والحريات بالإضافة إلى تحقيق الاستقرار السياسي، والتعديل الدستوري لسنة 2016 قد أعاد ترتيب وتشييد المجلس الدستوري بمنحه فعالية أكثر سواء من خلال الاستقلالية التي قررها له أو من خلال توسيع تركيبته وصلاحياته، أما عن الدستور التونسي فقد أوكل مهمة الرقابة الدستورية إلى "المحكمة الدستورية" والتي استحدثها بموجب دستور سنة 2014، بعدما كان يصطلح عليها "المجلس الدستوري" قبل هذا الدستور. من خلال هذه الورقة البحثية سوف نحاول التطرق إلى جملة التعديلات التي مست أسمى هيئة مكلفة بالرقابة الدستورية وهي المجلس الدستوري الجزائري إضافة إلى المحكمة الدستورية التونسية، ونقوم بقراءة قانونية تحليلية لأهم النقاط الأساسية التي مسها الإصلاح في هذا الإطار. The Constitution of Algeria has entrusted the Constitutional Council with the task of supervising the constitutionality of laws regardless of its form. The Council is considered one of the innovations of the 1989 Constitution, which makes it the hope of many to be an impregnable fortress for the protection of rights and freedoms as well as political stability. And the establishment of the Constitutional Council by granting it greater effectiveness, whether through its independence or through the expansion of its structure and powers. As for the Tunisian Constitution, the constitutional oversight task was entrusted to the Constitutional Court, which was created under the 2014 constitution. Through this paper, we will attempt to address the various amendments that have been made by the highest constitutional oversight body, the Algerian Constitutional Council, in addition to the Tunisian Constitutional Court. We are conducting an analytical legal reading of the main points of the reform in this regard.
الإعفـاء مـن المسؤوليــة المـدنيــة عـن حـوادث السيــارات

تعد السيارات من الأشياء غير الحية الملازمة لحياة الإنسان، فقد تعاظمت منافعها وفي نفس الوقت تزايدت مخاطرها إلى حد كبير نتيجة لما يترتب عليها من خسائر بشرية واقتصادية، وهذه المعادلة فرضها تعقد الحياة الحديثة نتيجة التطور السريع للآلة مما أدى إلى تضاعف حوادث المرور. ولقد أدى هذا التطور إلى التأثير على تطور قواعد المسؤولية المدنية عن حوادث السيارات، ولذا اتجه المشرع الجزائري أسوة بالتشريعات المقارنة إلى حماية المضرور من حوادث السيارات، وهذا لتمكينه من الحصول على التعويض سواء في مرحلة قيام المسؤولية أو الاعفاء منها. فبالنسبة للإعفاء من المسؤولية المدنية عن حوادث السيارات فإن عبء الاثبات ينتقل من المضرور إلى الحارس من خلال إثباته للسبب الأجنبي متى استوفى الشروط المحددة قانونا، غير أنّ هذا الاعفاء لا يكون كليا إلا إذا كان السبب الأجنبي هو السبب الوحيد للحادث، أما إذا اشترك مع فعل الحارس أو فعل السيارة فلا يهدم قرينة الإسناد إلا جزئيا. وضمن هذا السياق تتنأول هذه الورقة البحثية السبب الأجنبي للإعفاء من المسؤولية المدنية عن حوادث السيارات وصوره. Cars are non-living objects inherent in human life. Their benefits have increased and at the same time their risks have increased greatly as a result of human and economic losses. This equation imposed by the complexity of modern life as a result of the rapid development of the machine resulting in the doubling of traffic accidents. This development has influenced the development of the rules of civil liability for car accidents, and the algerian legislator, in parallel with the comparative legislation, has tended to protect the injured from car accidents, in order to enable him to obtain compensation both at the stage of liability and exemption. With regard to exemption from civil liability for motor vehicle accidents, the burden of proof is transferred from the victim to the guard by proving the foreign reason when he meets the legally prescribed conditions, but this exemption is complete only if the foreign cause is the only one cause of the incident. As for taking part in the act of the guard or the act of the car, it is only partially destroyed. In this context, this paper addresses the exemption from civil liability for car accidents, as well as the picture.
الاقتصاد الماليـزي: بيـن الوطنية الاقتصاديـة والتحـديات الخارجيـة

Several economical, political, and ethical factors, have contributed in the success of the Malaysian development experience, which has become a leading for other countries.
الالتـزام بالإعــلام قبل التعاقــد فـي التجـارة الالكترونيــة

تبنت جل التشريعات الدولية والوطنية مجموعة من الضوابط القانونية التي تحكم وتنظم العلاقة القانونية بين اطراف العقد، ويعتبر الالتزام بالإعلام من اهم الضمانات القانونية الوقائية المسبقة التي اوجدها التشريع لتنوير رضا المستهلك بأهم جوانب العلاقة التعاقدية الاستهلاكية، وضمان حمايته من الاضرار التي قد تصيبه من السلع لا سيما السلع الخطرة، والعون الاقتصادي ملزم بالإدلاء بالبيانات والمعلومات واوصاف المنتج ومميزات الخدمة للمستهلك بغية حماية رضاه وتنويره قبل التعاقد في مجال التجارة الالكترونية.The majority of the international and the national legislations adopted a set of legal regulations that govern and regulate the legal relationship between the parties to the contract, The commitment to information which is created by the legislation to enlighten consumer satisfaction in the most important aspects of the contractual relationship of consumers and to ensure the protection of the damage that may be caused by goods, especially dangerous goods and the economic aid is obliged to provide data, information, product descriptions and service features to the consumer in order to protect and enlighten his interests before contracting in the field of electronic commerce.
البعـد الـديني كحـل للحـد مـن حــوادث الطـرقـات

إن الأرقام المخيفة التي تقدمها المصالح المختصة عن حوادث المرور وما انجر عنها من أوضاع مأسأوية من قتلى وجرحى وخسائر فادحة في الممتلكات والأموال؛ تجعلنا ندق ناقوس الخطر، ونسعى جاهدين للحد من ظاهرة الإرهاب المروري الذي لن نجد له مصطلحا أفضل من هذا، من خلال رؤية متكاملة تترجمها منظومة شاملة تتنأول مختلف الأبعاد والأسباب التي تقف وراء هذه الظاهرة سواء تعلقت بالعامل البشري أو حالة المركبات أو حالة الطرق. ولعل من أهم الحلول التي نراها فعالة في محاربة هذه الظاهرة، هي إشراك الخطاب الديني الذي يباشره أهل الاختصاص من الأئمة والمرشدين وغيرهم في هذه الحملة، من خلال التربية والتوجيه، وبيان مسؤولية الدولة في إنجاز الطرق بمواصفات آمنة والسهر على ذلك، واستدامة المحافظة عليها، وأن مسؤولية السائق تكون من خلال توعيته وتربيته على احترام آداب الطريق، والتخلي عن الرعونة والتهور والطيش، والأخذ بيده والردع الحازم الحاسم لكل مخالفة منه لقواعد المرور من قبل الأجهزة المختصة، بعيدا عن المحسوبية والرشوة وما إلى ذلك من تصرفات منافية للأخلاق والمسؤولية. Perhaps one of the most important solutions we see effective in combating this phenomenon is to involve the religious discourse practiced by the imams, guides and others in this campaign, through education and guidance, and to demonstrate the responsibility of the state to achieve the roads with safe specifications and to ensure that, this is to maintain it. The responsibility of the driver shall be through his awareness and education to respect the etiquette of the road, to abandon graciousness, recklessness, and taking firm deterrent againstu any violation of the traffic rules by the competent organs, away from favoritism and bribery and other acts contrary to morality and responsibility.

إن الأرقام المخيفة التي تقدمها المصالح المختصة عن حوادث المرور وما انجر عنها من أوضاع مأسأوية من قتلى وجرحى وخسائر فادحة في الممتلكات والأموال؛ تجعلنا ندق ناقوس الخطر، ونسعى جاهدين للحد من ظاهرة الإرهاب المروري الذي لن نجد له مصطلحا أفضل من هذا، من خلال رؤية متكاملة تترجمها منظومة شاملة تتنأول مختلف الأبعاد والأسباب التي تقف وراء هذه الظاهرة سواء تعلقت بالعامل البشري أو حالة المركبات أو حالة الطرق. ولعل من أهم الحلول التي نراها فعالة في محاربة هذه الظاهرة، هي إشراك الخطاب الديني الذي يباشره أهل الاختصاص من الأئمة والمرشدين وغيرهم في هذه الحملة، من خلال التربية والتوجيه، وبيان مسؤولية الدولة في إنجاز الطرق بمواصفات آمنة والسهر على ذلك، واستدامة المحافظة عليها، وأن مسؤولية السائق تكون من خلال توعيته وتربيته على احترام آداب الطريق، والتخلي عن الرعونة والتهور والطيش، والأخذ بيده والردع الحازم الحاسم لكل مخالفة منه لقواعد المرور من قبل الأجهزة المختصة، بعيدا عن المحسوبية والرشوة وما إلى ذلك من تصرفات منافية للأخلاق والمسؤولية. التداعيات الاجتماعيتة والاقتصاديــة لحـوادث المـرور فـي الجـزائــر

الخسائر التي تسببها حوادث السيارات والمركبات تفوق غيرها من الخسائر الناجمة عن مختلف أنواع الجرائم، وأصبح عدد الضحايا من الوفيات والجرحى والمعاقين بسبب الحوادث المرورية في العالم، يتجأوز عدد الذين يقتلون أو يتأثرون سنويا بمختلف أشكال الصراعات والمنازعات الأمنية على المستوى الدولي؛ حيث قدرت التكلفة الاقتصادية لحوادث المرور ما بين 1 إلى 3% من إجمالي الدخل القومي لدول العالم، وأن 10% من أسرة المستشفيات في العالم تشغل بإصابات ناتجة عن حوادث الطرق، من هنا استحقت حوادث المرور أن تكون معضلة العصر، دون منازع. في الجزائر تمثل حوادث المرور هاجسا مخيفا بالنسبة لمستعملي الطرقات، لما حققته من ارتفاع مرعب في الأرقام، حيث تُخلّف حوادث السير في الجزائر 13 قتيلا و175 جريحا يوميا في المتوسط؛ أي بمعدل 4500 قتيل سنويا و3500 شخصا بعاهات مستديمة، يمثل الشباب غالبية ضحايا هذه الحوادث، ما دعا البعض إلى وصف هذه الظاهرة المرورية بإرهاب الطرقات. نظرا لأن الحوادث المرورية تسبب تكاليف ضخمة يتكبدها المجتمع من خسائر في الأرواح ما بين وفيات وإصابات كذلك إتلاف الممتلكات العامة والخاصة، ما ينعكس على الفاقد في الناتج الاقتصادي، جاءت هذه الدراسة لإبراز حجم الكلفة الاقتصادية والاجتماعية لحوادث المرور.
