    التوقيف على ذمة التحقيق دراسة مقارنة بين الفقه الإسلامي وقانون أصول المحاكمات الجزائية الأردني

    جاءت هذه الدراسة بهدف الوقوف على حقيقة التوقيف على ذمة التحقيق، والذي يعتبر من الإجراءات الاستثنائية الخطيرة التي لها مساس مباشر بحريّة الأفراد وتقيّدها، وكذلك انتهاكه لقاعدة: البراءة التي تعتبر مبدأ دستورياً، وقد خلصت الدراسة إلى عدد من النتائج منها: أن التوقيف على ذمة التحقيق يجب أن يكون محاطاً بقيود وضمانات للموقوف، ومنها أيضاً تعزيز وتفعيل إجراء الرقابة الإلكترونية كحل أمام تطبيق أمر الحبس المؤقّت أو -الحد منه. This study was made to negotiate the fact of arresting pending on investigations ,which consider on of the serious exceptional procedures that directly affect the freedom of individuals or restrict it , which also breaks the rule that: innocence which consider a constitutional principle. Based on , this study concluded a number of results ,such as: arresting pending on investigation must be within restrictions and guarantees for the arrested person, it also enhances and activates electronic monitoring procedure as a solution for applying the temporary confinement or even reduce it.
