    أسال موضوع الجريمة بوجه عام الكثير من الحبر باعتبارها من أخطر الظواهر الاجتماعية لما تشكله من تهديد لأمن واستقرار المجتمعات باختلاف أنماطها، وفي شتى المجالات كالاقتصادية والسياسية والعسكرية. فالجريمة المرورية لا تقل شأنا عن باقي الجرائم باعتبارها أصبحت هاجس يؤرق راحة وسلامة المجتمع لكثرة الحوادث وما تخلفه من أضرار مادية وبشرية وحتى نفسيةو عليه سنتنأول في هذه الورقة البحثية أسباب وعوامل تفاقم هذه الظاهرة والآثار الناتجة عنها مع إبراز العقوبات الردعية التي نص عليها القانون الجزائري، والتي تعتبر إلى جانب كونها عقوبات فهي مثبطات للحد من الوقوع تحت طائلة إرهاب الطرقات.The subject of the crime has become the focus of researchers as one of the most dangerous social phenomena because it poses a threat to the security and stability of societies according to their different types in various fields, including economic, political and military. Traffic crime is no less than the rest of the crimes as it became an obsession that disturbs the rest and safety of the community this paper discusses the causes and factors of the exacerbation of this phenomenon and the consequences there of, while highlighting the deterrent punishments stipulated in algerian law, which, besides being punishments, are inhibitors from falling under penalty of roads terrorism.

    ظــروف التشـديــد والتخفيـف للعقـوبــة فـي الجـريمــة المـروريــة

    شهدت حالات حوادث المرور بالجزائر تزايدا مرعبا ومخيف، مما استدعى تدخلا قانونيا واسعا لمواجهة هذه الظاهرة التي أصبحت تشكل واقعا ومأساة ومعاناة داخل المجتمع، مما جعل المشرع يشدد في معاقبة المتسببين في ارتكاب حوادث المرور، واتخاذ إجراءات صارمة ورادعة ضد مخالفي القوانين والنصوص التنظيمية المتعلقة بتنظيم حركة المرور عبر الطرق وسلامتها وأمنها . إلا أن المشرع وفي الوقت نفسه اخذ بالظروف المخففة للضالعين في ارتكاب حوادث المرور بدافع التقليل من الحوادث درءا للضرر .Traffic accidents have increased in algeria in terrifying and scary manner which required a wide legal intervention to face this phenomenon , which become a reality, tragedy and suffering in our society , because of that the legislator emphasizes on the punishment of criminals who are the cause of traffic accidents by taking rigorous procedures and deterrent against violators of laws and regulations related to safety, security and traffic movement , at the same time the legislator takes in consideration dilute circumstances for the involvers in traffic accidents to achieve the target of reducing accidents in order to prevent damage.
