دور التفـاؤل غيـر الـواقعي كمتغيـر نفسي فـي وقـوع حـوادث المــرور

تعاني العديد من الدول في ارتفاع أعــداد قتلى حوادث الطرقات وتفيد بعض الدراســـات والتنبؤات لخبراء منظمة الصحة الدولية الذين يتوقعون أن الإصابات الناجمة عن حوادث المرور سوف تزداد وتـــــؤدي إلى وفيات مالا يقل عن مليونين و400ألف نسمــــة بحلول عام( 2030) وأن الغالبـــــية منهم سوف يكون في الدول الناميـــة. والجزائر ضمن المراتب الأولى عربيا في حصيلة حوادث المرور التي ترتفع من سنة إلى أخرى لتزيد من عدد الضحايا ونسبة المعوقين والمصابين بمختلف العاهات. في هذا الإطــــــار كشفت أرقـــام المركز الوطني للوقايــــة والأمن عبر الطرق عن أزيد من (3718) قتيل وأكثرمن41 ألف جريح خلال سنـــة 2016. وأمام هذه الأرقام المخيفــــــة والارتفاع الرهيب في عدد الضحايا حرك فينا الإحساس بوجود المشكلة وبضرورة معالجتها وإيجاد طرائق لتقليل منها. والمتتبـــع للدراسات والبحوث المرورية يلاحـــظ أن أسبابــــها عديدة، فقد أرجعها البعض إلى طبيعة الطرقات وتأثير الأحوال الجوية، والبعض الأخر أرجعها إلى عوامل متعلقة بالمركبات وغالبية الدراسات أرجعتها إلى العنصر البشري، إذ بينت مصالح الدرك الوطني الجزائري أسباب هذه الحوادث إلى مجموعة من العوامل أهمها السرعة المفرطة، التجاوز الخطير، واللامبالاة، مهملين العامل النفسي فالإفراط في الثقة والميل إلى المخاطرة عوامل تلعب دورا هاما في بروز السلوك الذي يؤدي إلى ارتكاب الحوادث تتناول هذه الورقة البحثية دور التفاؤل غير الواقعي كمتغير نفسي له علاقة وطيدة بحوادث الـمرور. Many countries suffer from high death toll in road accidents some studies and forecasts are useful For world health organization experts who expect that dead traffic accidents will increase and at least two million and 400 people by 2030 the majority of them will be in developing countries. Algeria is among the top arab countries in the toll of traffic accidents that increase from year to year the number of victims and the proportion of people with various disabilities. In this context the national center for prevention and security of roads revealed more than 3718 killed and more than 41 thousand wounded during the year 2016. Faced with these frightening figures and terrible rise this incredible number of victims motion in our souls the sensation of the problem and the need to reduce it. tracker for traffic studies and research notes that there is many causes , some have returned it to the nature of roads and the impact of weather conditions, others return it t to vehicle-related factors but the majority of studies have attributed it to the human element, The interests of the algerian national gendarmerie indicated the causes of these accidents to the many factors the most important is excessive speed, dangerous transgression, apathy, neglecting the psychological factor excessive confidence and risk-taking factors play an important role in the emergence of behavior that leads to accidents. This research discusses the role of unrealistic optimism as a psychological variable has to do with traffic accidents.
آليـات الوقايــة مـن حـوادث الطـرقـات فـي الجـزائــر: مقاربـة تحـليليـة لأحكـام قانــون المــرور

تعتبر حوادث المرور من أخطر المشاكل التي باتت تهدد سلامة المجتمع الجزائري وأمنه نظرا لحجم الحصيلة السنوية الناجمة عنها وتكلفتها الاجتماعية والاقتصادية المرتفعة، وقد سعى المشرع الجزائري جاهدا بموجب قانون المرور إلى وضع آليات عملية من شأنها الحد من المخالفات المرتكبة على مستوى الطرق خاصة تلك التي تضمنها تعديل 2017، إلا أن هذه الآليات تتطلب وضع قواعد أخرى لتعمل إلى جانبها مما سيسأهم في الحد من إرهاب الطرقات.Due to the importance of their annual outcome, considerable social and economic cost, traffic accidents are considered to be of the most dangerous problems threatening the safety of algerian society. The algerian legislator tried hard, under traffic law, to put feasible mechanism that would reduce contraventions committed at the road, more than ever those contained in the amendment of 2017. However, such mechanisms require promulgation of other supporting rules to be practiced, which would contribute to reducing roads’ terrorism.
المـواجهــة الجـزائيــة المـوضـوعيــة لجـرائــم المـرور فـي الجـزائــر

تمثل حوادث المرور موضوعا ينال اهتمأما بالغا في مجال الأمن الإنساني وهاجسا مخيفا لمستعملي الطريق، لماتسببه يوميا من خسائر مادية، وبشرية ونظرا لانعكاساتها السلبية على الفرد والمجتمع، سواء من الناحية النفسية والاجتماعية والاقتصادية، ولما كانت أسباب هذه الحوادث ناجمة عن المخالفات المرورية بالدرجة الأولى، كان لزأما إتباع سياسة جزائية صارمة تضمن تطبيق قانون المرور وتفرض على مستعملي الطريق الانصياع لأحكامه. وقد أولى المشرع الجزائري أهمية بالغة لهذه الجرائم، من خلال سنه لترسانة من النصوص الجزائية الموضوعية التي تهدف إلى الحد أو التقليل منها، ورفع مستوى السلامة المرورية، إلاأنه وبالرغم من الجهود المبذولة في هذا المجال لا اتزال الجزائر تحتل مراتب متقدمة في حوادث المرور وتحصي أعدادا مرعبة لضحاياها. و في هذه الورقة سنقوم بدراسة عامة لسياسة التجريم، والعقاب التي تنتهجها الجزائر في مواجهة جرائم المرور، وسنحأول تقييم هذه السياسة من خلال تحليل الإحصائيات ذات العلاقة بالموضوع، ثم الوقوف على بعض العوائق التي تحول دون تحقيق الأهداف المرجوة منه. Traffic accidents represent a very important subject in the field of humansecurity, and a frightening concern for the road users .this is due to the daily physical and human losses that they generate and also to their negative psychological, social and iconomic impacts both on individuals and societies. Since the causes of these accidents are primarily due to traffic violations, a strict penal policy is required to ensure the application of the traffic law and to compel the road users to comply with its provisions. Therefore the algerian legislatur has given great importance to these crimes through its enactment of a series of substantive penal texts aimed at reducing accidents and raising the level of traffic safety.however,despite the efforts exerted in this domain, we are still experiencing increasing and terrifying numbers of traffic accidents and victims. In this paper we will study the general policy of criminalization and punishement of the algerian legislation in the face of traffic crimes. We will also try to evaluate this policy through the analysis of statistics related to this issue, and then to identify some of the obstacles that prevent the achievement of the desired goals.
النصـوص القانـونيــة ومـدى تأثيـرهـا فـي تحسيـن السلامــة المـروريــة

يعد موضوع السلامة المرورية من الموضوعات الحديثة التي تعاني منها المجتمعات المعاصرة بصفة عامة، والجزائر بصفة خاصة حيث اهتمت بهذه الظاهرة الخطيرة وذلك من خلال تنظيمها بنصوص قانونية. وهو ما ركزنا عليه في هذه المداخلة وذلك بتوضيح ما جاء به قانون المرور الجديد فيما يتعلق بالسلامة المرورية، وإبراز أهمية النصوص الجديدة في الحد من هذه الظاهرة، باعتبار قانون المرور 17/05 النسخة المعدلة الصارمة بنصوص أكثر دقة وصرامة وذلك ما يظهر من خلال إلزامية نصوصه وإحداثه لهيئات جديدة وتشديده في العقوبات وتنوعها، وذلك من اجل تحسين السلامة المرورية. The issue of traffic safety is one of the modern issues facing contemporary societies in general, and algeria in particular, where this dangerous phenomenon was dealt with through the organization of legal texts. This is what we focused on in this intervention by clarifying the new traffic law regarding traffic safety and highlighting the importance of the new texts in reducing this phenomenon, considering the traffic law 17/05 the strict modified version with more precise and strict texts, and to create new bodies and tighten it in the penalties and diversity, in order to improve traffic safety.
المخالفات المـروريـة لحاملي رخصـة السياقـة الأجنبيـة فـي التشريـع الجـزائــري

تسجل حوادث المرور أعلى معدلات حالات الوفاة في كل دول العالم، لذالك رصدت العديد من الموارد المادية والطاقات البشرية للحد منها ضمن منظومة قانونية مستجدة حيث نظمت طرق استخدام رخص السياقة العادية أو بالتنقيط والمخالفات التي يرتكبها حاملوها، ونظم أيضا مخالفات حاملي رخصة السياقة الأجنبية، حيث أقر التعديل لقانون المرور الاخير رقم 17-05 عقوبة الغرامة الجزافية بحسب إختلاف درجات جسامة حادث المرور، تدفع إجباريا حتى يسترد رخصة السياقة الأجنبية التي تثير التساؤول حول نجاعة هذه العقوبات في الحد من حوادث المرور المرتكبة من حاملي رخصة السياقة الأجنبية سواء جزائريين أو أجانب في الارض الجزائرية . traffic accidents were the highest rates of deaths in all countries of the world, and for that purpose made many of the material resources and human potential to reduce them within the emerging legal system where organized ways to use regular driving licenses or the drip and irregularities committed by vectors, also organized the holders of foreign driving license violations, where the amendment approved last traffic law no. 13-03 penalty of a predatory pricing according to the different degrees of seriousness of the traffic accident, pay compulsory to recover foreign driving license, which raises the question about the efficacy of these sanctions in reducing traffic accidents committed by holders of foreign driving license both algerians and foreigners in the land of algeria.
دور المركـز الوطني للوقايــة والأمـن عبر الطرق فـي التقليل من حـوادث المـرور

أصبحت حوادث المرور مصدر قلق لجميع الدول، فهي تستنزف الموارد البشرية والمادية للمجتمع إضافة إلى أنها سبب في المشاكل النفسية الاجتماعية لافرادها، لذلك فإن مواجهة هذه المشكلة يجب أن تكون مبنية على أسس علمية تقوم على تضافر مختلف الجهود والأجهزة المتخصصة، لذلك بادرت الجزائر إلى إنشاء جهاز متخصص للحد من هذه الظاهرة والمتمثل في المركز الوطني للوقاية والأمن عبر الطرق، الذي تتمثل مهمته الأساسية في توجيه السياسة الوطنية للوقاية من حوادث المرور والإشراف عليها وتقديم برامج وقائية من شأنها احداث تغيرات جوهرية اتجاه سبل الوقاية من حوادث المرور. والاشكالية التي نحن بصدد معالجتها تتمثل في: فيما يتمثل الدور الذي يقوم به المركز الوطني للوقاية والأمن عبر الطرق في الحد من ظاهرة حوادث المرور؟. وللإجابة على هذا التساؤل نتطرق إلى التعريف بالمركز الوطني للوقاية والأمن عبر الطرق ومهامه، بالاضافة إلى الدور الذي يقوم به في سبيل تحقيق السلامة المرورية ووضع الإجراءات الوقائية، من خلال وضع التدابير اللازمة لذلك والقيام بالحملات التحسيسية والتوعوية ونشر الثقافة المرورية والتي كان لها الأثر في تدعيم نظام المرور وعاملا هأما في التقليص من حوادث المرور. Traffic accidents have become a source of concern for all countries. They drain the human and material resources of the society, as well as cause psychological and social problems. Therefore, the face of this problem must be based on scientific foundations based on a combination of different efforts and specialized agencies. Specialized in the national center for road safety and security, whose main task is to guide the national policy for the prevention and control of traffic accidents and to provide preventive programs that will significantly change the direction of road traffic prevention. The problem that we are dealing with is: what is the role of the national center for prevention and security of the road in reducing the Phenomenon of traffic accidents? To answer this question we refer to the definition of the national center for prevention and security through roads and its functions, in addition to the role it plays in order to achieve safety of traffic and the development of preventive measures, through the development of the necessary measures and to carry out awareness campaigns and awareness and dissemination of traffic culture, which have had the effect of strengthening traffic system is an important factor in reducing traffic accidents.
نظــام رخصــة السياقــة بالنقـاط

إن الهدف من هذه الدراسة القيام بعرض الأهمية التي يكتسيها تفعيل نظام الرخصة بالنقاط في التقليل من حوادث المرور في الجزائر، والبحث في هذا الموضوع يقتضي التطرق إلى ماهية نظام الرخصة بالنقاط وآليات تطبيقه، وقبل ذلك يجدر التعرض إلى المخالفات والجنح المرورية التي نص عليها قانون المرور رقم17/05 والتي على أساسها يتم احتساب النقاط وخصمها، لنصل إلى نتيجة أساسية تتمثل في كون نظام الرخصة بالنقاط نظام ردعي ووقائي سيسأهم تطبيقه في تحسين السلامة المرورية في الجزائر.Our work aims to show the importance of the application of the permit system in order to reduce the rate of road accidents in algeria. Before that, it is necessary to address the issue of the offenses of the highway code no. 17/05 on the basis of which the points are calculated and deducted; to lead to the fact that the system of the point license contributes to improve the road safety in algeria.
التعويـض عـن الأضـرار الجسمانيــة فـي حـوادث المــرور: قــراءة نقـديــة للنصـوص القانـونيــة

إيمانا من المشرع بضرورة حماية ضحية حوادث المرور باعتباره الطرف الضعيف في هذه المعادلة، تبنى نظأما للمسؤولية يقوم على أساس المخاطر وذلك بموجب نص المادة 08 من الأمر 74/15 المعدل بالقانون 88/31، التي تشمل التعويض التلقائي دون مراعاة مسؤولية أي طرف في الحادث تطبيقا لنظرية الحق في الضمان، بل أن قضاء المحكمة العليا استقر على تعويض ضحايا حوادث المرور حتى في حالة صدور حكم ببراءة السائق، كما وضع المشرع نظأما لكيفية حساب التعويضات عن حوادث المرور تخلله النقص تارة، وتناقض تارة أخرى، مما جعل المحكمة العليا تتضارب في أراءها ومواقفها، حول بعض المسائل المتعلقة بحساب التعويضات، الأمر أصبح من ضروري تدخل المشرع لتعديل وتحيين النصوص المتعلقة بنظام التعويض عن الأضرار الجسمانية في حوادث المرور . In the belief of the legislator that the victim of traffic accidents should be protected as the weak party in this equation, a liability regime based on risk is established in the provisions of article 80 of order 74/15, as amended by law 88/31, which includes automatic compensation without taking into account the liability of any party to the incident to the theory of the right to security. Indeed, the supreme court's ruling confirmed this principle and went even further, and settled on compensating the victims of road accidents even in the case of a verdict of acquittal of the driver, in addition, the legislator has developed a system for calculating the compensation for traffic accidents, which is sometimes deficient, and contradicts others, which made the supreme court conflicting in its views and positions on some issues related to the calculation of compensation. It is necessary that the legislator intervene to amend and update the provisions relating to the system of compensation for bodily harm traffic accidents.
نظم النقل الذكية كإستراتيجية للتقليل من حوادث المرور - دراسة في تجارب بعض الدول العربية والأجنبية -

بالرغم من أهمية النقل البري من خلال تسهيل حركة نقل المسافرين والبضائع، إلا أن هذه الحركة المرورية السريعة التي ظهرت نتيجة لتزايد وسائل النقل كانت لها تأثيرات سلبية على البيئة الحضرية لعل أهمها على وجه الإطلاق هو تزايد حوادث المرور التي أضحت تخلف وراءها العديد من الخسائر البشرية والمادية سنويا. وبالنظر للتأثيرات السلبية لحوادث المرور فقد بات لزأما إيجاد آليات يمكن من خلالها التقليل من حدوث هذه الحوادث المرورية، ولعل من بين أهم هاته الآليات هي استخدام تكنولوجيات الحاسب الآلي والالكترونيات والاتصالات والتحكم لمجابهة حوادث المرور وبالتالي المسأهمة في تحسين مستويات السلامة المرورية وهو الأمر الذي سنحأول دراسته بشيء من التفصيل مع إبراز أهم التجارب العربية والأجنبية الرائدة في هذا المجال. Despite the importance of road transport in facilitating the movement of passengers and goods, the increasing number of transport means has resulted in speedy traffic movement what, in its turn, has led to negative effects on the urban environment in terms of an increased number of traffic accidents resulting in the important human and physical losses annually. With regard to those negative effects of the traffic accidents on the psychological, social and economic aspects, it is necessary to find mechanisms allowing reducing them. One of those mechanisms and may be the most important one is the use of computer, electronics, communication and control technologies to deal with traffic accidents and therefore contributing to road safety improvement. In this context goes our contribution, through this paper, to highlight these mechanisms referring to some arab and foreign experiences in this field.
أثـر تعديـل قانون المـرور الجزائري رقم 17/05 على واقـع ظاهرة حـوادث الطرقات

تمثل ظاهرة حوادث الطرقات مشكلا، وهاجسا مخيفا بالنسبة لمستعملي الطرقات في الجزائر، نظرا لما تخلفه من أرقام مخيفة في الخسائر المادية، والبشرية. ونظرا لأن مشكلة الحوادث المرورية لها علاقة بالقوانين والتشريعات المتعلقة بتنظيم حركة المرور فإن الدولة الجزائرية لم تدخر أدنى جهد في البحث عن أسباب الظاهرة، ومواجهتها بسن النصوص القانونية التي تراها مناسبة من حيث الزمان، والمكان لتحقيق السلامة المرورية، حيث جاء التعديل الأخير لقانون المرور رقم 17/05 للتقليل من حدة الظاهرة. وجاءت هذه الدراسة كقراءة تحليلية لأهم أحكامه سعيا إلى تبيان الفجوة الموجودة بين النصوص القانونية، والواقع المعاش. The phenomenon of road accidents is a problem and a frightening cocren for the road in algeria, because of the frightening figures in the material and human losses. Since the problem of traffic accidents has to do with the laws and the traffic laws, the algerian state has spared no effort in searching for the causes of the phenomenon and facing them by enacting the legal texts it deems appropriate in terms of time and place to achieve traffic safety no.17/05 to reduce the severity of this phenomenon. And this study came as an analytical reading of the most important provision in order to show the gap between the legal texts and the reality of the pension.
المخالفـات المـروريــة وفقا لقانــون المــرور الجـديــد

تعدّ الحوادث المرورية من أبرز المشكلات التي تواجهها الدول المعاصرة، لاسيما وأنّها في ارتفاع مستمر مخلفة خسائر مادية وبشرية، الأمر الذي دفع بهذه الدول لتبني سياسات قانونية للحد من تفاقم هذه الظاهرة، والجزائر واحدة من هذه الدول التي أصدرت نصوصا لتنظيم حركة المرور. فقانون المرور يهدف أساسا إلى تحقيق السلامة المرورية من خلال تنظيم حركة المرور الخاصة بالمركبات والسائقين والراجلين، لذا اهتمّ المشرع الجزائري بتدعيم المنظومة الردعية للتقليل من ارتكاب المخالفات المرورية من خلال جملة من التعديلات التي مست قانون المرور وآخرها القانون 05/17 وعليه تثور الإشكالية حول: مدى مسأهمة قانون المرور الجزائري لاسيما التعديل الجديد2017 في التصدي لمشكلة مخالفات المرور؟Trafics accidents are one of the most important problems faced by contemporary countries, especially in the fact that they are constantly on the increase, causing loss and human suffering. The traffic law aims primarily at achieving traffic safety by regulating the traffic of vehicles, drivers and pedestrians, so the algerian legislator took care to strengthen the deterrent system to reduce the commission of traffic violations through a number of amendments to the traffic law, most recently law 05-17, the extent of the contribution of the algerian traffic law, especially the new amendment 2017, to address the problem of traffic violations.
آثـار حــوادث الطـرقـات على صحـة الفـرد النفسيـة

قد ينتج عن الحوادث المرورية صدمات نفسية للمصابين وهي لا تقتصر على مرتكب الحادث بل تمتد إلى مرافقيه وأسرهم جميعاً وحتى من يشاهد الحادث. وقد تظهر أعراض هذه الاضطرابات بعد عدة أسابيع من الإصابة بالصدمة أو عدة شهور أو سنوات حسب ظروف كل حالة على حدا، وهو ما سأقوم بدراسته من خلال هذا البحث، بالتركيز على أهم الآثار النفسية لحوادث المرور. Traffic accidents may result in psychological shocks to the injured and are not limited to the perpetrator of the accident, but can extends to his companions and their families and even everyone who sees the incident. Symptoms of these psychoses may appear several weeks after the shock, or several months or years depending on the circumstances of each case That’s what i will to study in this search, by focusing on the most important psychological effects of the accidents
السيـاقــة التهـوريــة وحــوادث المــرور: قــراءة فـي الأسبـاب النفسيــة

إن حوادث المرور مشكلة أصبحت تفرض نفسها على الصعيد العالمي والمحلي، نظرا لنتائجها وآثارها الكارثية على الجانب البشري والاقتصادي، فقد أصبحت الوفيات والإصابات الخطيرة الناتجة عن تلك الظاهرة من المشكلات الرئيسية التي تهدد الإنسان في صحته ووجوده. وتخلف الحوادث عددا من الضحايا يضاهي عدد ضحايا الحروب والصراعات المسلحة، فإضافة إلى عدد الوفيات والمصابين جسديا لاختلاف درجة الإصابة من إصابات خفيفة إلى إصابات شديدة وحتى إعاقات وفقدان أعضاء، مضيف حصيلة المصدومين نفسيا. والمجتمع الجزائري كغيره من المجتمعات يعاني وبكثرة من مشكلة حوادث المرور خاصة وأنه مصنف في المراتب الأولى عالميا وعربا ضمن أكثر الدول بها أكبر نسبة حوادث مرور، ويعود ذلك لعدة أسباب أهمها العنصر البشري، حيث يعتبر المتسبب الأول في هذه الحوادث وذلك نتيجة العديد من الأسباب أهمها تبني سلوكات الخطر أثناء القيادة، كالإفراط في السرعة وعدم احترام الإشارات والاهتمام بأشياء أخرى أثناء السياقة وغيره. ونسعى في هذه المداخلة إلى توضيح أسباب حوادث المرور ذات السبب البشري وتبيان العوامل التي تؤدي بالفرد إلى انتهاج سلوكات الخطر أثناء القيادة. Road accidents are one of the most serious problems at the global and local levels, because of their impact on economic and human fields. The deaths and serious injuries resulting from this phenomenon have become real problems threatening human health. The number of victims of these accidents is equal to the number of victims of war, while traffic accidents leave many dead, wounded, disabled and amputees; as well as psychologically traumatized. Algeria suffers from this problem and ranks first in the world with a large number of accidents for several reasons, including the humanitarian factor through risky behavior while driving, such as excessive speed, lack of respect for signs and lack of concentration while driving. The purpose of this intervention is to explain the causes of these human-caused accidents and to identify the factors that lead the individual to adopt risk behaviors while driving.

تضطلع وسائل الإعلام والاتصال، على تنوّع قطاعاتها وتعدّد توجّهاتها، بممارسة العديد من الأدوار المجتمعية؛ التي تستهدف من خلالها مختلف شرائح المجتمع من جمهور المتلقّين بالإشباع والتأثير والتوجيه، ويعتبر تكوين الوعي المجتمعي الإيجابي أحد الأهداف التي تتطلّع وسائل الإعلام والاتصال إلى رعايتها وتعزيزها وتكريسها في مجالات مختلفة. من خلال هذا المقال نحأول تسليط الضوء على جانبٍ من الأدوار التي تضطلع بها وسائل الإعلام والاتصال عموما، في إطار نشر الوعي المجتمعي في ميدان ومجال مجتمعي مهم، هو عنوان الانتظام والتنظيم، وهو نشر وتعميم الوعي بأهمية احترام وتطبيق والتزام العمل بالتشريع الناظم لسير الحركة المرورية، أو ما يصطلح على تسميته: الوعي القانوني المروري. The media and communication, in the diversity of their sectors and their multiplicity of orientations, exercise many societal roles, through which different segments of society are targeted at the audience with satisfaction, influence and guidance, and the formation of positive societal awareness is one of the goals that aspire of information and communication to its sponsorship, promotion and dedication in various areas. Through this article, we are trying to highlight part of the roles played by the media and communication in general, in the context of spreading community awareness in an important field and community area, the title of regularity and organization, which is awareness of the importance of disseminating and promoting awareness of the importance of respect, application and commitment to the legislation regulates traffic traffic, or what it is called: traffic legal awareness..
دور الشـرطــة فـي مـواجهــة حـوادث المــرور

لا شك ان الارتفاع المتزايد في النتائج السلبية لظاهرة حوادث المرور شكل هاجسا مؤرقا لجميع الأجهزة والمؤسسات ذات الصلة علي غرار مؤسسة الشرطة التي تعتبر من الفاعلين الرئيسيين في مجال مكافحة ظاهرة حوادث الطرقات التي مافتئت تزهق أرواح الكثيرين من مستعملي الطريق العام سواء كانوا من فئة السواق أو الركاب أو حتى الراجلين من مستعملي الطريق. باعتبار أن آلة الموت والدمار التي تخلفها ظاهرة حوادث الطرقات الناجمة عن حوادث المرور لا تفرق بين من يستعمل الطريق العام مهما كانت صفته، فإن الحصائل الثقيلة التي تسجل يوميا في هذا المجال من ضحايا بشرية أو خسائر مادية، دفعت بجهاز الشرطة الي إيجاد حلول من اجل الحد من هذه الظاهرة أو التقليل من أضرارها ومخلفاتها لما لها اثر سلبي على الدولة من حيث الافراد أو من الجانب الإقتصادى الناجم عن الدمار المادى الذي تخلفه هذه الظاهرة. نحأول في هذه الورقة البحثية تسليط الضوء علي جهود جهاز الشرطة الجزائرية في مواجهة ظاهرة حوادث الطرقات من خلال استعراض مختلف الهيئات والهياكل المعدة لهذا الغرض في محور أول، ثم نتطرق الي مختلف برامج المديرية العامة للأمن الوطني في مجال الحد من إرهاب الطرقات أو التخفيف من أضراره في محور ثاني. There is no doubt that the increasing rise in the negative results of the traffic accidents phenomenon has been an urgent concern for all the relevant bodies and institutions, such as the police establishment, which is one of the main actors in the fight against road accidents, which has claimed the lives of many users of the public road whether they are drivers or passengers or even pedestrians. considering that the machine of death and destruction caused by the phenomenon of traffic accidents caused by traffic accidents does not differentiate between the use of the public road, whatever its status, the heavy tolls recorded daily in this area of human casualties or material losses, prompted the police to find solutions to reduce of this phenomenon or reduce its damage and its consequences because it has a negative impact on the state in terms of individuals or the economic side resulting from the physical destruction caused by this phenomenon. in this paper, we attempt to highlight the efforts of the algerian police force to confront the phenomenon of road accidents by reviewing the various bodies and structures prepared for this purpose in the first axis, and then we refer to the various programs of the directorate general of national security in the field of reducing road terrorism or reducing its damage. ظاهرة حوادث الطرق بحصيلتها المفزعة، عالميا ووطنيا وبأخطارها التي اتت على الاخضر واليابس فاستحقت حتمية التسمية (ارهاب الطرقات). وإذا كان مرد اسبابها عوامل متعددة: بشرية، تقنية، تقلبات الاحوال الجوية، فان القاسم المشترك بين جميعها دائما هو الانسان. وان مساعي التصدي لعلاجها تجلت في قانون تنظيم حركة المرور عبر الطرق وامنها وسلامتها بأحكامه الردعية مرافقة بأحكام وقائية لم تتحقق نتائجها بعد رغم مرور قرابة النصف قرن. والدواء الشافي الكافي للعلة يكمن في تعبئة الجميع من خلال تحمل الدولة لمسؤولياتها لترقية أمن الطرق وسلامتها، والمجتمع بكافة اطيافه (المدرسة، المسجد المجتمع المدني) كل من موقعه للقيام بالدور التربوي (التحسيس والتوعية) وهي السبل المثلى لتعلم احترام القانون كأساس محوري للحد والتقليل من إرهاب الطرقات. The phenomenon of road accidents with its dramatic consequences at both national and international levels and its risks and dangers can only be considered as road terrorism. There are many possible causes underlying accidents, as human factor, meteorological changes and technical factor, among which the common factor is always the human behavior. Road accidents is a world-wide problem which has not been solved to satisfaction for half a century even through the implementation of the road traffic organization, safety And police law throughout its dissuasive and preventive provisions. A form of social mobilization is necessary by creating more awareness amongst the community (schools, mosques and civil society). This leads to the conclusion that the road safety awareness is the most effective mean to ensure better compliance and this could be a major way for road terrorism reduction to combat for road safety.

تزخر الحياة الإنسانية بكم هائل من التهديدات الموجهة للمحيط الذي يتواجد فيه الفرد، مما يجعله عرضة لما يعرف في علم النفس بالعصاب الصدمي، والذي ينتج عن تعرض الفرد لخبرة صادمة والتي تتصف بكونها عبارة عن حادث يخرج عن نطاق الخبرة الإنسانية العادية وتسبب الخوف أو العجز أو الرعب العميق للناس جميعا. ولعل أكبر صدمة يمكن للإنسان أن يتلقاها هي تلك التي تضعه في مواجهة مفاجئة مع الموت، هذه المواجهة التي تدفعه للتفكير باحتمال موته في أي لحظة أو في فترة معينة من الزمن، وهو ما قد يحدث لضحايا حوادث الطرقات، وقد دلت البحوث على أن ضحايا مختلف الصدمات يشيع لديهم حدوث اضطراب كرب مابعد الصدمة والذي تتمثل أهم خصائصه في إعادة الخبرة، التجنب، وزيادة الإثارة.وعليه تسعى الدراسة الحالية إلى توضيح مظاهر إضطراب ضغط مابعد الصدمة لدى ضحايا حوادث الطرقات، واقتراح بعض طرق التكفل .Human life is full of threats to the environment in which the individual is present, exposing him to what is known in psychology as post-traumatic stress disorder, which results from the traumatic experience of the individual and which is characterized by an accident outside of the normal human experience thus raising the fear, the handicap or the deep terror for all the people. The most serious shock that a person may receive is perhaps the one that places him/her in a sudden confrontation with death. That confrontation pushes this person to consider the possibility of his/her death at any moment or at a certain time. This is exactly what happens to the victims of road accidents. According to several studies, it is common among victims of various traumas to undergo a post-traumatic stress whose most important characteristics are regaining experience, avoidance and excitement. Therefore, the present study seeks to clarify the different aspects of the post-traumatic stress disorder among the victims of road accidents as well as to propose certain methods of support
ظــروف التشـديــد والتخفيـف للعقـوبــة فـي الجـريمــة المـروريــة

شهدت حالات حوادث المرور بالجزائر تزايدا مرعبا ومخيف، مما استدعى تدخلا قانونيا واسعا لمواجهة هذه الظاهرة التي أصبحت تشكل واقعا ومأساة ومعاناة داخل المجتمع، مما جعل المشرع يشدد في معاقبة المتسببين في ارتكاب حوادث المرور، واتخاذ إجراءات صارمة ورادعة ضد مخالفي القوانين والنصوص التنظيمية المتعلقة بتنظيم حركة المرور عبر الطرق وسلامتها وأمنها . إلا أن المشرع وفي الوقت نفسه اخذ بالظروف المخففة للضالعين في ارتكاب حوادث المرور بدافع التقليل من الحوادث درءا للضرر .Traffic accidents have increased in algeria in terrifying and scary manner which required a wide legal intervention to face this phenomenon , which become a reality, tragedy and suffering in our society , because of that the legislator emphasizes on the punishment of criminals who are the cause of traffic accidents by taking rigorous procedures and deterrent against violators of laws and regulations related to safety, security and traffic movement , at the same time the legislator takes in consideration dilute circumstances for the involvers in traffic accidents to achieve the target of reducing accidents in order to prevent damage.

تلعب مؤسسات المجتمع المدني دورا فعالا في نشر الثقافة المرورية وتحقيق السلامة المرورية في مختلف دول العالم سواء كانت متقدمة أم نامية. وفي الجزائر، تعتبر الجمعية الوطنية للسلامة المرورية، واحدة من أهم الجمعيات التي تمارس عملها الإنساني في تحقيق السلامة المرورية والحد من تفاقم حوادث المرور. تتمحور هذه الدراسة حول توضيح أهمية الدور الذي تلعبه مؤسسات المجتمع المدني في تحقيق السلامة المرورية في الجزائر، وتركز على الجمعية الوطنية للسلامة المرورية كنموذج عن العمل الجمعوي الهادف في هذا المجال. عـدم الالتـزام بشروط الأمـن والسلامـة فـي عقـود تسويـق المركبـات الجـديـدة - كسبب لحـوادث المـرور فـي الجـزائــر -

تعتبر المركبة من الاختراعات الحديثة التي لعبت دورا كبيرا في النهوض بالإنسان والمجتمعات في كافة المجالات، غير أن إساءة استعمالها أو صناعتها بشكل لا يحقق أمنها وسلامتها قد يجعل منها أداة للقتل وعامل أساسي في وقوع حوادث المرور، هذه الأخيرة التي تعتبر من أبرز وأخطر المشكلات المعاصرة التي تعيق التطور والتنمية الاجتماعية والاقتصادية في المجتمعات، لذا فإن المشرع الجزائري على غرار التشريعات الحديثة قام بسن مجموعة من الأحكام القانونية التي تفرض على مستورد المركبات الجديدة من الدول الأجنبية إلى أرض الوطن الالتزام بتحقيق شروط أمن وسلامة هذه المركبة وهذا ما سنتحدث عنه من خلال هذه المداخلة.The vehicle is one of the modern inventions that played a major role in the advancement of human beings and societies in all fields. However, misusing them or making them in a way that does not achieve their safety can make them a killing tool and a key factor in traffic accidents. The algerian legislator, like modern legislation, has enacted a set of legal rules that impose on the importer of new vehicles from foreign countries to the homeland the obligation to achieve the conditions of security and safety of this vehicle , and this is what we will talk about through this intervention.
