يقر الفقه الإسلامي نظام التعدد ومناطه النهي عن كل ميل، وهي ذات المسألة التي اعتنقها قانون الأسرة الجزائري وحاول تقييدها بضوابط توحي بالتضييق من نطاقه والحد منه أو منعه، ولعلها تحفز أكثر على فك الرابط الزوجي بدل توثيقه وتؤثر سلبا على فرص التكافل الاجتماعي.In the framework of the Islamic law, it admits the polygamy marital system in its entire concept, so as to avoid any other inclination.
It is the same issue adopted by the Algerian Family Code with an attempt to create some regulating restrictions, aiming at narrowing its extent, reducing or prohibiting it. Furthermore, it stimulates the dissolution of marriage bounds instead of reinforcing them and has a negative impact on the social equity.
