ينطوي نظام روما على أحكام تتعارض مع بعض النصوص الدستورية للدول العربية , هذا ما شكل عائقا لانضمامها إلى المحكمة الجنائية الدولية. حيث تتمثل أهم المعوقات الدستورية في: مبدأ السيادة، الحصانات، تسليم الرعايا ونظام العفو. مما يستوجب إجراء مواءمة دستورية مع أحكام نظام روما .The statute of Rome appears in contradiction with constitutional provision of the Arab states ,wich seems to constitute obstacles called upon buy these states on the constitutional level are the principle of national sovereignty,immunities,handing-over of the nationals and amnesty. To overcome this kinds of difficulties the constitutional provision of the Arab states must be compatible with those of the Rome statute.
