النظام القانوني الجزائري لحماية البيئة في إطار التنمية المستدامة

Abstract

This study treats the Algerian legislation of environment protection under the context of sustainable development. Environmental legislations are the set of laws, systems and regulations that manage the way to prevent and protect the environment from upcoming aggressions, through conserving natural resources in addition to preventing and controlling pollution using laws set by the legislative authority and regulations coming from the executive authority in the state. The study displays the legal conception adopted by the legislator in designing an accurate legal policy, aiming to conserve the environment through legal provisions embodied in various mechanisms in line with the Algerian environment, as they varied from preventive to deterrent characters. This is through which the environmental legislator aimed to create an equal interaction and a mutual balance of service between the environment and sustainable development aiming to protect the environment and link it to the idea of achieving sustainable development. تتناول هذه الدراسة معالجة التشريع الجزائري لموضوع حماية البيئة في اطار التنمية المستدامة. ان المقصود بالتشريعات البيئية: مجموعة القوانين و الانظمة و اللوائح التي تنظم كيفية وقاية و حماية البيئة من الاعتداءات التي تطالها، و ذلك بالمحافظة على الثروات الطبيعية و منع التلوث و السيطرة عليه، بواسطة القوانين الصادرة عن السلطة التشريعية او اللوائح الصادرة عن السلطة التنفيذية في الدولة. تكشف هذه الدراسة عن التصور القانوني الذي تبناه المشرع في رسم سياسة بيئية مضبوطة، تهدف الى المحافظة على البيئة عن طريق احكام قانونية مجسدة في اليات متعددة تتوافق مع البيئة الجزائرية، فتنوعت بين الطابع الوقائي و الردعي، الذي سعى المشرع البيئي من خلالها الى خلق تفاعل متساوي و توازن خدماتي متبادل بين البيئة و التنمية المستدامة. استهدف من خلالها اسباغ الحماية على البيئة و ربطها بفكرة تحقيق التنمية المستدامة.
