الذكاء الاصطناعي وتأثيره على أحكام براءة الاختراع

Abstract

إن الاعتماد على التقنيات التكنولوجية الحديثة المتعلقة بالذّكاء الاصطناعي في الوصول إلى الاختراعات، جعل القواعد المنظمة لبراءات الاختراع تواجه مستجدات وإشكاليات جديدة، لا سيما فيما يتعلق بمدى ملاءمة تطبيق شروط منح براءة الاختراع على الابتكارات التي تم التوصل إليها بالاستعانة بتلك التطبيقات أو بمساهمة كلية منها، كما أصبحت القواعد التقليدية عاجزة عن تحديد شخص المخترع عندما يتعلق الأمر باختراع مستنبط من تقنيات الذكاء الاصطناعي المطورة ذاتيًا دون تدخل الإنسان، فمن جهة لا يمكن منح البراءة لمبتكر التطبيق لأنه لم يشارك بأي طريقة في الوصول إلى الاختراع، ومن جهة أخرى لا يمكن اعتبار التطبيق نفسه مخترعًا لعدم تمتعه بالشخصية القانونية، لذلك يتعين إدخال تعديلات على القواعد المنظمة لبراءة الاختراع بما يتوافق مع الثورة التقنية التي شهدها مجال الذكاء الاصطناعي The reliance on modern technological techniques related to artificial intelligence in the development of inventions has led to new developments and challenges for the rules governing patents, especially regarding the applicability of patent granting conditions to innovations achieved with the aid of such applications or with their full contribution. Traditional rules have become inadequate when it comes to identifying the inventor in cases where the invention is derived from self-developed artificial intelligence technologies without human intervention. On one hand, the patent cannot be granted to the creator of the application because they did not participate in any way in the invention process. On the other hand, the application itself cannot be considered the inventor due to its lack of legal personality. Therefore, amendments must be made to the rules governing patents to align with the technological revolution witnessed in the field of artificial intelligence.
