أثـر تعديـل قانون المـرور الجزائري رقم 17/05 على واقـع ظاهرة حـوادث الطرقات

Abstract

تمثل ظاهرة حوادث الطرقات مشكلا، وهاجسا مخيفا بالنسبة لمستعملي الطرقات في الجزائر، نظرا لما تخلفه من أرقام مخيفة في الخسائر المادية، والبشرية. ونظرا لأن مشكلة الحوادث المرورية لها علاقة بالقوانين والتشريعات المتعلقة بتنظيم حركة المرور فإن الدولة الجزائرية لم تدخر أدنى جهد في البحث عن أسباب الظاهرة، ومواجهتها بسن النصوص القانونية التي تراها مناسبة من حيث الزمان، والمكان لتحقيق السلامة المرورية، حيث جاء التعديل الأخير لقانون المرور رقم 17/05 للتقليل من حدة الظاهرة. وجاءت هذه الدراسة كقراءة تحليلية لأهم أحكامه سعيا إلى تبيان الفجوة الموجودة بين النصوص القانونية، والواقع المعاش. The phenomenon of road accidents is a problem and a frightening cocren for the road in algeria, because of the frightening figures in the material and human losses. Since the problem of traffic accidents has to do with the laws and the traffic laws, the algerian state has spared no effort in searching for the causes of the phenomenon and facing them by enacting the legal texts it deems appropriate in terms of time and place to achieve traffic safety no.17/05 to reduce the severity of this phenomenon. And this study came as an analytical reading of the most important provision in order to show the gap between the legal texts and the reality of the pension.
