مقاصد الشريعة بين التهوين والتهويل دراسة تأصيلية نقدية

Abstract

لا تزال الجهود المبذولة في الاعتناء بمقاصد الشريعة في العصر الحديث تحتاج إلى مزيد من نظرات التقييم والتقويم، حرصًا على تفعيل دورها الخطير في فهم النصوص الشرعية واستنباط الأحكام من جهة، وتجنبًا لمسارات الشطط والتخبط من جهة أخرى. وقد حاول هذا البحث في المبحث الأول أن يرصد نقاط التهوين من دور المقاصد المتمثلة في قضايا الاستدلال، واستنباط الأحكام، واختص المبحث الثاني برصد نقاط التهويل من شأن المقاصد من جهة الإسهاب في تفاريع أقسامها وأنواعها، والاحتجاج بها، وتوليد مقاصد لا يصح ادعائها أو التمسك بها. وكان من أهم النتائج ضرورة تفعيل المقاصد على سَنَن الأولين، معتنين بالتطبيق والتمثيل، غير منشغلين بكثرة التنظير والتقعيد الذي يفقد المقاصد روحها ودورها في ضبط الاجتهاد وفهم النصوص. The efforts made to pay attention to the objectives of Sharia in the modern era still require more critical consideration and evaluation Activating the important role of objectives in understanding legal texts and deriving rulings on the one hand, and avoiding paths of excess and confusion on the other hand. In the first section, this research attempted to monitor the points of downplaying the role of objectives represented in issues of inference and derivation of rulings. The second section was concerned with monitoring the points of exaggeration of objectives in terms of exaggerating their categories and types, and using them as evidence, while finding objectives whose claims are not valid. One of the most important results was the necessity of activating the objectives according to the approach of the ancients, who cared about application and representation, and were not preoccupied with the abundance of theorizing and strictness that made the objectives lose their role in controlling diligence and understanding texts.
