حقـــوق الفـــنان على ضوء قانون حقوق المؤلف والحقوق المجاورة الجزائري.

Abstract

يعتبر فنانوا الأداء حلقة وصل فعالة في صناعة الثروة الثقافية وتنمية الإبداع الوطني. لذا اهتم المشرع بهذه الفئة ومنحهم مجموعة امتيازات ذات طابع أدبي وطابع مالي، بالنظر إلى ما يؤدونه من مصنفات أدبية ومسرحية أو موسيقية. ونتيجة للتطورات الحديثة في وسائل الاتصال أصبح من السهل نسخ الأداء أو التسجيل والبرنامج الخاص بحقوق الفنانين، الأمر الذي تطلب تدخل المشرع الجزائري لمنع وقوع قرصنة على هذه المصنفات بحيث يسمح باستغلال أمثل لحقوقهم المادية والمعنوية، وعند وجود خرق يتدخل القضاء لوضع حد للاعتداءات التي تقع على هذه الحقوق. Performance artists are considered as an effective link in creating the Cultural Revolution and developing the national creativity. This is why the legislator was interested in this category and granted them literal and financial privileges, regarding to their achievements in literal, theater and musical works. Due the development in communication means, it is easy to copy the performance or records and programs related to artist’s rights, which required the intervention of the Algerian legislator to prevent the piracy on these works, so they can well use their financial and moral rights. The justice will intervene to put an end to the attacks on these rights in case of a breach.
