الآليات القانونية لتسيير النفايات المنزلية بين التكريس القانوني وصعوبات التجسيد (دراسة على ضوء تقرير مجلس المحاسبة لسنة 2019)

Abstract

تهدف هذه الورقة البحثية إلى تسليط الضوء على مدى فعالية البلديات في تجسيد الآليات القانونية لتسيير النفايات في الممارسة الميدانية، مما يقتضي الاستعانة بالمنهج التحليلي لتحليل مختلف النصوص القانونية المنظمة تلك الآليات القانونية ومحاولةاسقاطها على التجربة الميدانية لطائفة من البلديات التي شملهتها رقابة مجلس المحاسبة، الذي أدرج عملية رقابة سنة 2017 لتقييم مدى فاعلية عملية تسيير النفايات المنزلية، وانبثق عن تلك الرقابة، صدور تقرير له سنة 2019، سجل فيها عدة صعوبات حالت دون تنفيذ تلك الآليات على أرض الواقع، وقصد معالجة تلك النقائص قدمنا جملة من التوصيات أهمها، ضرورة التنفيذ الفعلي للمخططات البلدية لتسيير النفايات فضلا عن التوجه نحو الاستغلال الغير مباشر بدلا من الاستغلال المباشر الذي اثبت عدم نجاعته، وضرورة حرص البلديات على وضع الإجراءات العملية الازمة لتحصيل رسم النفايات، وتوسيع انجاز مراكز الردم التقني. This research paper aims to shed light on the effectiveness of municipalities in embodying legal mechanisms for waste management in field practice, which requires the use of the analytical method to analyze the various legal texts The organization of these legal mechanisms and an attempt to apply them to the field experience of a range of municipalities covered by the oversight of the Accountability Council, which included an audit process in 2017 to assess the effectiveness of the process of managing household waste, and from this monitoring, a report was issued in 2019 , which recorded several difficulties that prevented the implementation of these The mechanisms on the ground, and in order to address these shortcomings, we made a number of recommendations, the most important of which is the need for the actual implementation of municipal plans for waste management, as well as the trend towards indirect exploitation instead of direct exploitation, which has proven ineffective, and the need for municipalities to be keen on setting practical procedures necessary to collect the waste fee , and expanding the completion of technical backfill centers.
