التوجه الجديد للسياسة الجنائية في الجزائر

Abstract

After the picture of contemporary criminal policy with all its international values and philosophical controls and its impact on the outcomes of globalization was completed, it reached the stage of maturity after its unification with human rights and freedoms, as countries worked to adopt this contemporary trend, and so did Algeria within the framework of its international obligations, as this was reflected on The applications of constitutional legitimacy in it, and the signs of the development of legal thought by the Algerian legislator appeared through the project of justice reform, and rights and freedoms were strengthened in substantive and procedural legislation, and guarantees of justice were supported, and the punitive treatment was humanized, and all available alternatives were activated and protection was provided. Criminal justice against all human crimes, and the opening of control frameworks, so the endeavors to reform justice in Algeria were linked to the humanization of the penal rules within the requirements of its new criminal policy. بعد ان اكتملت صورة السياسة الجنائية المعاصرة بكل قيمها الدولية و ضوابطها الفلسفية و تاثرها بمخرجات العولمة وصلت الى مرحلة النضوج بعد توحدها مع حقوق الانسان و حرياته حيث عملت الدول على تبني هذا التوجه المعاصر، و كذلك فعلت الجزائر في اطار التزاماتها الدولية، حيث انعكس ذلك على تطبيقات الشرعية الدستورية فيها، و ظهرت بوادر تطور الفكر القانوني لدى المشرع الجزائري من خلال مشروع اصلاح العدالة، و تم تعزيز الحقوق و الحريات في التشريعات الموضوعية و الاجرائية، و دعمت ضمانات العدالة، و تم انسنة المعاملة العقابية و تفعيل كل البدائل المتاحة و توفير الحماية الجنائية ضد كل الجرائم الانسانية، و فتح اطر الرقابة، فارتبطت مساعي اصلاح العدالة في الجزائر بانسنة القواعد الجزائية ضمن مقتضيات سياستها الجنائية الجديدة.
