مسؤولية الرؤساء و القادة أمام القضاء الدولي الجنائي

Abstract

تبحث هذه الدراسة في المسؤولية الدولية الجنائية التي يتحملها الرؤساء والقادة الذين يتورطون في ارتكاب جرائم دولية، و بعد نجاح الأجيال المتعاقبة للقضاء الدولي الجنائي في استبعاد الحصانة التي يتمنع بها أولئك المسؤولون و تقديم العديد منهم للمحاكمة، يبقى الرهان الحقيقي هو تكثيف الجهود من أجل الوقوف في وجه التوظيف الانتقائي للعدالة الدولية الجنائية، و الذي بات يوفر لكار المجرمين مزيدا من فرص الإفلات من العقاب. This study examines the international criminal responsibility assumed by the heads of states and leaders who are involved in the commission of international crimes, and after the success of the successive generations of the International Criminal Justice in excluding the immunity enjoyed by those responsible and bring many of them to justice, the real issue is the intensification of efforts to deal with the selective application of international criminal justice, which provides more impunity opportunities to major criminals. Cette étude examine la responsabilité internationale assumée par les chefs d'états et les dirigeants qui s'impliquent dans la commissions des crimes internationaux, et suite à la réussite des générations successives de la Justice Pénale internationale dans l'exclusion de l'immunité dont jouissent ces responsables et traduire beaucoup d'entre eux devant la justice, le réel enjeu demeure l'intensification des efforts afin de faire face à l'application sélective de la justice pénale internationale, qui fournit aux grands criminels plus d'opportunités d'impunité.
