سنن القرآن في تشريع الأحكام

Abstract

ملخص البحث تناول هذا البحث فكرة جديدة في طرحها، قديمة في إثارتها؛ فقد أشار إليها علماؤنا في كتبهم ومصنفاتهم؛ لكنها منثورة، تحتاج إلى لم شتاتها وتبويبها، والاستفادة منها في الدرس الفقهي؛ هذه الفكرة هي كيف أن القرآن الكريم في بيانه للتشريع سنَّ سنناً تيسر للمكلفين الامتثال للأحكام العملية والتسليم بها؛ تسليم المحب لربه الرفيق به. وكان عنوان هذا البحث (سنن القرآن الحكيم في تشريع الأحكام)، حيث شمل هذا البحث مقدمة، وتعريف بمصطلحات البحث الهامة، ثم ذكرت السنن، وتطبيقات عملية على هذه السنن من القرآن مكتفياً في الغالب بثلاثة أمثلة متنوعة؛ ليتضح المقصود. وكان من أهم النتائج: - سنة القرآن الحكيم أن يبين مع كل حكم حِكْمَة تشريعه، وفائدته في تقوية الإيمان، ويمزج الكلام فيه بما يذكر بعظمة الله تعالى، ويُعِين على مراقبته، والتوجه إليه، ويثبت الإيمان به، من القصص، والترغيب والترهيب، والموعظة، واختيار الألفاظ التي يستحيا من التصريح بها؛ ليقتدي بهدي القرآن العلماء. - أن العلماء اهتموا بهذا الجانب وبينوه في كتبهم، وكان أكثر المهتمين بذلك الإمام الرازي في تفسيره مفاتح الغيب، والشيخ رشيد رضا في تفسيره المنار. - توصل العلماء إلى هذه السنن والعادات القرآنية في التشريع بالاستقراء من آيات القرآن. وكان من أهم التوصيات: القيام بدراسة علمية شاملة ومستوعبة لسنن القرآن الحكيم في تشريع الأحكام. الكلمات المفتاحية سنن – القرآن –التشريع – الأحكام Research summary This research dealt with a new idea in its presentation, which is old in its stir. Our scholars referred to it in their books and works; but it is scattered, which does not need to be scattered and should be classified, and to benefit from it in the fiqh lesson; This idea is how the Holy Qur’an in his statement of legislation enacted a Sunnah that facilitates those Assigned with complying with the practical provisions and recognizing them; handing over the lover to his companion Lord. The title of this research was (Sunnah of the Wise Quran in the Legislation Judgment), where this research included an introduction, and definition of important research terms, then I mentioned the Sunan , and practical applications on these Sunnahs of the Qur’an are often satisfied with three different examples; to clarify what is meant. The most important results were: The Sunnah of the wise Qur’an is to show with every rule the wisdom of its legislation, and its usefulness in strengthening faith, and mixing the words in it with what is mentioned by the greatness of Allah, and helps to monitor it and go to it, and prove faith in it, from stories, endearing, intimidation, sermon, and choosing words that are ashamed of declaring With it, for the scholars to follow the guidance of the Qur’an. That the scholars cared about this aspect and mentioned it in their books, and Imam Razi was the most interested in that in his interpretation Mafatih Al Ghayb, and Sheikh Rashid Reda in his interpretation of Al-Manar. The scholars have reached these Sunnahs and Quranic wont in legislation by extrapolating from the verses of the Qur’an. Some of the most important recommendations were: Carrying out a comprehensive scientific study that accommodates the Sunnah of the Holy Qur’an in the legislation of rulings. key words Sunan - the Qur’an - legislation - judgments
