الحق في الحصول على المعلومة ودورها في مكافحة الفساد (قراءة في التشريعات ذات الصلة)

Abstract

تهدف هذه الدراسة البحث في بيان دور الحق في الوصول إلى المعلومة في مكافحة الفساد، فبعد الوقوف عند كل من تعريف الحق في تداول المعلومة وتحديد الاإطار القانوني له، توصلت الدراسة إلى أن الحق في النفاذ إلى المعلومة يساهم بدرجة كبيرة في مكافحة الفساد، وذلك من خلال الكشف عن جوانب الإهدار والإحتيال وعدم الكفاءة والعجز، وتبيان الأخطاء والتجاوزات التي تقع فيها الحكومات، فيكون بوسع الأفراد أو الصحافيين من خلال الحصول والوصول إلى المعلومات كشف الأخطاء وكشف بؤر الفساد وإستغلال السلطة لتحقيق الأغراض الشخصية.، وتوفير حماية أساسية ضد عمليات إساءة إستخدام السلطة وسوء الإدارة والفساد. وهو ما يعتبر رادعا للفساد- وغيره من المساوئ- خوفا من الكشف والمحاسبةThis study aims to research the role of the right to access information in the fight against corruption. After standing in both the definition of the right to circulation of information and determine the legal framework, the study concluded that the right to access information contributes significantly to the fight against corruption, By discovery the aspects of waste, fraud, incompetence and impotence, and to identify errors and abuses made by governments, so that individuals or journalists through access to information can detect errors, uncover the focal points of corruption and abuse of power for personal purposes, and providing a main protection against the use of power, mismanagement and corruption. Which is considered a deterrent to corruption- and other disadvantages- for fear of disclosure and accountability.
