دراسة تحليلية لجريمة القذف في ظل أحكام قانون الإعلام رقم 12 - 05

Abstract

تهدف هذه الورقة البحثية إلى دراسة جريمة القذف التي تعتبر من الجرائم التي تنال من شرف واعتبار الأشخاص. خاصة مع تزايد دعاوى المسؤولية المتعلقة بها بشكل ملحوظ في السنوات الأخيرة. وتوصلنا في هذه البحث إلى وجود جهود كبيرة من طرف المشرع الجزائري في ظل التعديل الأخير لقانون الإعلام لأجل التصدي لهذه الجريمة، من خلال تشديد العقوبات الواردة عليها. ولاحظنا أيضا وجود العديد من النقائص والتناقضات، وغياب تنسيق فيما بين قانون العقوبات وقانون الإعلام، سنقوم بالتطرق إليها في متن البحث. This paper aims to study the crime of defamation, which is considered to be crimes against honor and consideration of the persons being. In particular, with claims of responsibility having increased significantly in recent years . In this research, we have found that there are considerable efforts by the Algerian legislature under the recent amendment of the Information Act to deal with this crime, through the tightening of the penalties. We have also noted that there are many shortcomings and contradictions, and that there is no coordination between the Penal Code and the Media Act, which we will look at in the search.
