سؤال الخصوصية الإجرائية في متابعة الجرائم الإلكترونية في التشريع الجزائري من خلال إجراءات البحث والتحري

Abstract

لقد تطور الإجرام في العصر الحديث بسبب استخداما المجرمين لتكنولوجيات الحديثة في تنفيذ سلوكياتهم الإجرامية بنوع من الذكاء والاحترافية، فظهرت إلى الوجود أشكالا جديدة من الجرائم لم تكن معروفة من قبل، والتي بات يطلق عليها اسم الجرائم الإلكترونية نسبة إلى وسيلة تنفيذها. وفي سبيل أداء رجال القضاء أو الضبطية القضائية لصلاحيتهم في تتبع هذه الجرائم وكشف مرتكبها، عادة ما تعترضهم بعض الإشكاليات الإجرائية، الناتجة أساسا عن خصوصية هذه الجريمة، خاصة من جانب أدلتها الإلكترونية أو الرقمية، وهو ما يعيق دورهم في الكشف عن وقائع الجريمة وهوية مرتكبها. وتكمن أهداف البحث في الكشف عن جوانب هذه الاشكاليات والصعوبات وكيفية التعامل معها من قبل رجال القضاء. وفي ظل خلو المنظومة التشريعية لمعظم الدول من القوانين الإجرائية التي تنظم هذا النوع من الجرائم بما فيه الجزائر، فإن أمر مواجهتها تعتريه الكثير من الصعوبات والعراقيل، خاصة في ظل استحالة تطبيق أحكام قانون الإجراءات الجزائية على هذا النوع من الجرائم، لذلك بات من الضروري تدخل المشرع من أجل استحداث بعض الإجراءات لتسهيل مهمة رجال القضاء والضبطية القضائية في إنفاذهم للقانون ومواجهة هذه الجرائم المستجدة والخطيرة، ومن ثم التغلب على تلك العراقيل التي تعترض سبيلهم، والإجابة عن تلك الإشكاليات. In modern times criminality has evolved because criminals use modern technologies to carry out their criminal behaviors, which we call and describe as cybercrime. So in this paper we will study some procedural aspects that raise some problems for the judiciary or judicial discipline in order to exercise their competence to track and detect such crimes not by their physical conviction but by their electronic or digital evidence. In order for the judiciary or judicial officers to exercise their power to trace and detect such crimes, they are often confronted with certain procedural problems, arising mainly from the crime's privacy, especially by its electronic or digital evidence, which hampers their role in disclosing the facts and identity of the perpetrator. Despite theabsence of laws in the legislative system of most States governing this type of crime, including Algeria. The problematic is how can they be confronted in this legal vacuum? Can the Code of Criminal Procedure and its supplementary laws withdraw its texts and provisions on cybercrime? Or should the legislator intervene in order to introduce possible procedures to facilitate the judicial and police officers; task of enforcing the law and confronting such emerging and serious crimes?
