جائحة كرونا مقاربة قانونية مدنية وإجرائية

Abstract

تثير جائحة كرونا المستجدة مفاعلة مفاهيمية من باب المقاربة مع الأحكام القانونية العامة، والتي تكشف على أصول ثابتة تضبط التعاملات التعاقدية المبرمة بين الأشخاص، من خلال أحكام الوعد، وكذا أحكام مبدأ القوة الملزمة للعقد، كما تؤدي هاته الجائحة لتعطيل العمل ببعض الأحكام الثابتة في قانون الإجراءات المدنية والإدارية وتفعيل العمل بأحكام أخرى له، سواء أثناء انعقاد الخصومة القضائية وسيرها أو خلال سريان مرحلة الطعون القضائية، أو في المرحلة التنفيذية للسندات القضائية النهائية، وفضلا عن ذلك تتطلب هاته الجائحة تطبيقا سلسا للأحكام القانونية المدنية والإجرائية ذات الصلة، من خلال تفعيل دور القضاء بما له من سلطة تقديرية،والتي ينبغي أن تربط ما بين الجائحة من جهة، والتعامل أو الإجراء من جهة أخرى The novelty Corona pandemic gives rise to conceptual controversy in terms of approach to general legal provisions, which reveals firm principles that govern the contractual transactions between persons, through the provisions of the promise to contract, and the provisions of the principle of the binding force of the contract, this pandemic also results in the suspension of some provisions laid down by the law of civil and administrative procedures and the activation of other provisions, either the holding of the judicial proceeding and its resumption, or during the period of legal remedies, or during the executive stage of the final judicial titles,in addition,this pandemic requires the proper application of the relevant civil and procedural legal provisions, by activating the role of justice at its discretion, which should link the pandemic on the one hand, and the transaction or procedure on the other.
