Abstract

إنفرد المشرع الجزائري بتقرير حق الطعن القضائي في حقوق العينية العقارية بعد شهرها مخالفا بذلك مبدا القوة الثبوتية المطلقة كأهم مبادئ نظام الشهر العقاري العيني، وبذلك أقر بالحجية النسبية للدفتر العقاري ومنح كل من له مصلحة في رفع دعوى قضائية لإلغاء الترقيم النهائي، ويكون الحكم القضائي النهائي كاشفا عن حق المالك الجديد، والتي يتوجب على المالك السابق بموجب الدفتر العقاري ايداع الدفتر العقاري لدى المحافظة العقارية التي يتواجد بها العقار لضبط الدفتر العقاري بالمعلومات الجديدة بمناسبة شهر الحكم القضائي النهائي بإلغاء الترقيم النهائي للمالك السابق، وتطرح إشكالية عدم تسليم الدفتر العقاري من طرف المالك الذي ألغي ترقيمه النهائي وفقد حق ملكيته على العقار، لذلك نركز عليها بدراسة الآثار القانونية المترتبة عن شهر الحكم القضائي بإلغاء الترقيم النهائي.The only report a month after Algerian legislators'judicial challenge to real estate rights is the opposite principle of absolute power, such as the most important principle of the monthly real estate system, and This is an acknowledged debate over the relativity of real estate books, giving everyone an interest in the abolition of the final number in the proceedings and reagents for the final judicial decision on the rights of new owners.
