ابن الشقاق القرطبي: حياته وآراؤه الفقهية

Abstract

حفظت لنا كتب المالكية في الفقه والنوازل والأحكام والوثائق ثروة ضخمة من الآراء والاجتهادات الفقهية، ومن أعلام المالكية الذين لهم حضور في تلك المصنفات ابن الشقّاق القرطبي، والبحث يُعرف بعصره، وحياته الاجتماعية والعلمية، ويعرض لبعض آرائه الفقهية، مذيلة بالتعقيب المناسب من نقول وأقوال فقهاء المذهب، ومن نتائج البحث أنَّ مدار فقه ابن الشقّاق واجتهاداته على المدوّنة؛ تفسيرًا لمعانيها، وتخريجًا على أقوالها، وجريًا على أصول أئمّة المذهب في الاجتهاد، كابن القاسم.

The Maliki books on jurisprudence, controversial issues (disputes), rulings and documents have preserved for us a huge wealth of jurisprudential views and efforts. Among the Maliki scholars who have a presence in those works is Ibn Al-Shaqqaq Al-Qurtubi. The research introduces his era, his social and scientific life, and presents some of his jurisprudential views, followed by an appropriate commentary from the sayings and statements of the jurists of the school. Among the results of the research is that the basis of Ibn Al-Shaqqaq's jurisprudence and efforts is on AL_MUDAWWNA; an explanation of its meanings, and deducing its statements, and following the principles of the imams of the school in ijtihad, such as Ibn Al-Qasim.
