النظم الانتخابية كضمانة لنزاهة الانتخابات التشريعية في ظل الأمر رقم 21-01

Abstract

لقد شكلت النظم الانتخابية في الجزائر نقطة هامة في إعادة صياغة القواعد المتعلقة بالانتخابات، وذلك من خلال بروز جملة من الإصلاحات الجوهرية التي كان لها أثرا مباشرا على تقويم العملية الانتخابية، بهدف التجسيد الفعلي لنزاهة الانتخابات التشريعية وضبطها من خلال تبني إجراءات مستحدثة بشأن النظم الانتخابية، الأمر الذي يستدعي تقييمها من حيث محاسنها ومدى تكيفها مع الواقع العملي، حيث أنه وبموجب الأمر رقم 21-01 المتعلق بنظام الانتخابات لم يعتمد المشرع على نمط واحد في تحديد النتائج المؤقتة للاقتراع إذ أنه أخذ بنظام التمثيل النسبي وكذا نظام الأغلبية في ظل الانتخابات التشريعية. The electoral systems in Algeria have constituted a crucial point in redefinition the rules related to elections, through the emergence of a series of fundamental reforms that had a direct impact on evaluating the electoral process, aiming to effectively embody integrity by regulating the electoral process through reliance on various methods to conduct elections. This necessitates assessing these methods in terms of their merits and their adaptation to practical reality, Under the Ordinance No. 01-21 focused on both direct and indirect voting methods, It did not rely on a single pattern in determining the provisional results of the vote, as it considered both proportional representation and majority systems in legislative elections.
