النظام القانوني للجنة المصرفية في الجزائر (قراءة في القانون رقم 23/09 المتضمن القانون النقدي والمصرفي)

Abstract

تهدف هذه الدراسة إلى بيان الدور الذي تلعبه اللجنة المصرفية في النشاط المصرفي وإبراز الدور الرقابي الذي تلعبه هذه الهيئة على الأجهزة المصرفية من خلال مراقبة البنوك والمؤسسات المالية من حيث تطبيقها للأحكام التشريعية والتنظيمية المطبقة عليها، وفي حالة الإخلال بها يتم معاقبتها بناءً على المعاينات التي تقوم بها مع بحثها شروط استغلال البنوك والمؤسسات المالية بعد حصولها على ترخيص والاعتماد لممارسة النشاط البنكي، وتسهر على نوعية وضعياتها المالية. وتستعرض الدراسة النظام القانوني لهذه اللجنة من خلال تحديد التشكيلة البشرية لها والصلاحيات الممنوحة لها في إطار الرقابة على الهيئات المصرفية وقد خلصت الدراسة إلى أن اللجنة المصرفية تلعب دور هام في المنظومة المصرفية حيث أعطى المشرّع الجزائري بموجب القانون النقدي والمصرفي للجنة المصرفية وسائل قانونية من أجل ضمان فعالية مراقبة الهيئات المصرفية إما على أساس المستندات أو على أساس مراكز البنوك والمؤسسات المالية، من خلال دراسة هذه الوثائق يمكن لمصالح المراقبة التأكد من مدى احترام التنظيمات، ومن مدى تطور الوضعيات المالية وتجميع المعلومات المحاسبية لتحديد الوضعية المالية للمؤسسات المعنية. كما تعاين المخالفات التي يرتكبها أشخاص يمارسون النشاط المصرفي دون أن يتم اعتمادهم وفقا للشروط القانونية وتطبق عليهم العقوبات التأديبية المنصوص عليها. كما تعاين المخالفات التي يرتكبها أشخاص يمارسون النشاط المصرفي دون أن يتم اعتمادهم وفقا للشروط القانونية وتطبق عليهم العقوبات التأديبية المنصوص عليها. This study aims to explain the role that the Banking Committee plays in banking activity and to highlight the supervisory role that this body plays over banking devices by monitoring banks and financial institutions in terms of their application of the legislative and regulatory provisions applied to them, and in the event of a violation of them, they are punished based on inspections. Which it carries out by examining the conditions for exploiting banks and financial institutions after obtaining a license and accreditation to practice banking activity, and ensuring the quality of their financial positions The study reviews the legal system of this committee by determining its human composition and the powers granted to it within the framework of oversight of banking bodies. The study concluded that the Banking Committee plays an important role in the banking system, as the Algerian legislator, under the Monetary and Banking Law, gave the Banking Committee legal means in order to ensure the effectiveness of monitoring banking bodies, either on the basis of documents or on the basis of the positions of banks and financial institutions. Through studying these Documents: Monitoring services can verify the extent of compliance with regulations, the extent of development of financial positions, and compile accounting information to determine the financial position of the institutions concerned. It also examines violations committed by persons practicing banking activity without being accredited in accordance with the legal conditions and applies the stipulated disciplinary penalties to them.
