قراءة في أحكام غرامة الصلح كآلية لحماية المستهلك على ضوء قانون حماية المستهلك وقمع الغش 09 – 03

Abstract

لما كان مجال الاستهلاك ميدانا خصبا لوقوع التجاوزات وارتكاب المخالفات التي تضرّ بصحة المستهلك وسلامته ومصلحته؛ فقد اهتم التشريع الجزائري بحماية المستهلك أيّما اهتمام من أشكال هذه التجاوزات والمخالفات، وفي هذا الإطار تأتي هذه الدراسة لتبحث جانبا من الحماية التي قرّرها التشريع الجزائري للمستهلك؛ حيث تتناول بالبحث المُفصّل والمُؤصّل غرامة الصلح كآلية لحماية المستهلك، وتُقدّم قراءة تحليلية لتعريف غرامة الصلح والأحكام المتعلقة بالمخالفات التي تستوجب فرض غرامة الصلح، وأيضا إجراءات فرضها وكيفيات تبليغها، كلّ ذلك على ضوء أحكام قانون حماية المستهلك وقمع الغش رقم 09 – 03.
