دور الرعاية اللاحقة للحدث المنحرف المفرج عنه فـي تحقيق اندماجه الاجتماعـي

Abstract

تعتبر الرعاية اللاحقة أسلوبا تكميليا من أساليب المعاملة التقويمية للحدث المنحرف المفرج عنه، لأنها تقوم بمساعدته على تحقيق تكيفه النفسي والاجتماعي أو استعادته مرة أخرى، وتجعله يتغلب على الصعوبات والعراقيل التي تعترض حياته الاجتماعية، النفسية، التعليمية، المهنية. ونظرا لأهمية الرعاية اللاحقة ودورها فـي تحقيق الاندماج الاجتماعي للحدث المفرج عنه نجد المشرع الجزائري قد نص عليها فـي بعض النصوص القانونية التشريعية والتنظيمية المتعلقة بحماية الطفل. وفي هذا السياق تندرج هذه الدراسة، الذي تهدف إلـى التعرف على دور الرعاية اللاحقة المقدمة للحدث المنحرف المفرج عنه فـي تحقيق اندماجه الاجتماعي من خلال الخدمات والبرامج التي تقدم له. لقد وقع انتهاج المنهج الوصفي التحليلي في هذه الدراسة من خلال الوقوف على واقع الرعاية اللاحقة وتحليل دورها فـي تحقيق الاندماج الاجتماعي للحدث المنحرف المفرج عنه، عبر استقراء بعض الدراسات النظرية واستنطاق بعض النصوص القانونية. هذا وقد كشفت الدراسة على جملة من النتائج أهمها: أن الرعاية اللاحقة للحدث المفرج عنه استكمال للمعاملة التقويمية لسلوك الحدث المنحرف بعد الإفراج عنه، ولضمان تحقيق أهدافها المتمثلة فـي استعادة الحدث لثقته بنفسه وبأسرته وبمجتمعه ككل، وانخراطه فـي الحياة الاجتماعية الطبيعية، بالعيش في أسرة، ومتابعة الدراسة فـي مدرسة أو متابعة تكوين مهني أو حرفي فـي مركز أو ورشة، لا بد أن تقوم على خطط وبرامج مدروسة يوكل تنفيذها لهيئات مجتمعية وحكومية مؤهلة. Aftercare is considered as complementary method of the corrective treatment of the released deviant juvenile, because it helps him achieve his psychological and social adjustment or restore it again, and makes him overcome the difficulties and obstacles that hinder his social, psychological, educational, and professional life. Given the importance of aftercare and its role in achieving the social integration of the released juvenile, we find that the Algerian legislator has stipulated it in some legislative and regulatory legal texts related to child protection, this study aims to identify the role of the aftercare provided to the released deviant juvenile in achieving his social integration through the services and programs provided to him.The descriptive analytical approach was adopted in this study by examining the reality of aftercare and analyzing its role in achieving the social integration of the released deviant juvenile, by extrapolating some theoretical studies and interrogating some legal texts.The study revealed a number of results, the most important of which are: that the after-care of the released juvenile is a complement to the corrective treatment of the deviant juvenile’s behavior after his release, and to ensure the achievement of its goals of restoring the juvenile’s confidence in himself, his family and society as a whole, and his involvement in the normal social life, by living in a family, and following up on the study.
