دور وزارة العلاقات مع البرلمان في توطيد و تنسيق العلاقة بين الحكومة و البرلمان في الجزائر

Abstract

The Constitution of 1996 has adopted the principle of supple separation of powers relying on the mutual cooperation between the powers, especially between the executive power and the legislative one. It has put in place several rules and mechanisms to consolidate the cooperation and the complementarity between them for the sake of the public interest, among which we can cite the ministry of the relations with the parliament. Thus, in order to make the cooperation effective and continuous between the two powers, and to elevate the functional performance between the government and the parliament, a ministry of the relations with the parliament was created in 1997, its role is the promotion of the relations between the government and the parliament and the facilitation of the dialogue between them, whenever the government and the parliament have different conceptions of a given issue, this will not cause a confrontation between the two institutions, as the supreme interest of the state and the democratic choice is related to the quality of the relation that govern them. The ministry of the relations with the parliament is in the core of the relation between the powers, hence, it is very important to study its organization and role, and this is cannot be done without tackling the details and the reality of the functional relation between the government and the parliament particularly in the domain of legislation and in the domain of the parliamentary control over the government action. تبنى دستور 1996 مبدا الفصل المرن بين السلطات القائم على التعاون المتبادل بين السلطات، خاصة بين السلطة التنفيذية و السلطة التشريعية، و لقد وضع عدة قواعد و اليات لترسيخ معاني التعاون و التكامل بينهما خدمة لصالح العام، و من بين هذه الاليات نجد وزارة العلاقات مع البرلمان. اذن من اجل جعل التعاون فعالا و مستمرا بين السلطتين، و رفعا من مستوى الاداء الوظيفي بين الحكومة و البرلمان انشئت وزارة العلاقات مع البرلمان في سنة 1997، ينصب دورها على ترقية العلاقات بين الحكومة و البرلمان و تسهيل الحوار بينهما، فاذا كان للحكومة و البرلمان تصورات مختلفة حول هذا الموضوع او ذاك، لا يمكن ان ان يشكل تصادم بين هاتين المؤسستين، اذ ان تحقيق المصالح العليا للدولة و الخيار الديمقراطي مرهون بنوعية العلاقة التي تحكمهما. ان وزارة العلاقات مع البرلمان تقع في قلب العلاقات بين السلطات، فمن الاهمية بمكان دراسة تنظيمها و دورها، و لا يمكن التعرض لدراستها دون التعرض لتفاصيل و واقع العلاقة الوظيفية بين الحكومة و البرلمان خاصة في مجال التشريع و في مجال الرقابة البرلمانية على اعمال الحكومة.
