قراءة في القانون رقم: 24-01 المتضمن تدابير خاصة للحصول على النفقة في الجزائر

Abstract

تعد النفقة؛ من الحقوق المالية التي يكفل القانون حمايتها، لاسيما متى تعلقت بفئة الطفولة، حيث نجد أن قانون الأسرة الجزائري أوجب في المادتين 75 و76 منه، نفقة الطفل على أبيه- حال قيام العلاقة الزوجية-، وفي حالة عجزه، ينتقل الإلزام للأم متى كانت لها القدرة على ذلك. إلا أنه غالبا ما تثور إشكالية أَحَدُّ، بمناسبة انحلال العلاقة الأسرية، والمتمثلة في امتناع الأب عن القيام بواجب الإنفاق على الأطفال المحضونين، كليا أو جزئيا، فضلا عن عدم تسديد نفقة المرأة المطلقة المحكوم لها بذلك قضاء، وهو ما يخلق حالة من عدم الاستقرار المالي لهؤلاء، غالبا ما تتفاقم أثاره الاجتماعية، الاقتصادية والنفسية... وقصد احتواء مثل هكذا انعكاسات، عمد المشرع الجزائري إلى إصدار القانون رقم: 24-01 المؤرخ في: 11/02/2024، المتضمن تدابير خاصة للحصول على النفقة (الذي ألغى أحكام القانون رقم: 15-01 المؤرخ في: 04/01/2015 المتضمن إنشاء صندوق النفقة في الجزائر)، وهو ما أستهدف تجلية مشتملاته؛ مدلول النفقة في هذا القانون، شروط وإجراءات الاستفادة من المستحقات المالية، إلى جانب بيان الأحكام المالية له. Pension is taken into account; Among the financial rights whose protection the law guarantees, particularly when they fall under the category of childhood, we note that the Algerian Family Code requires, in its articles 75 and 76, that child support either the responsibility of the father-once the marital relationship is established- and, in case of incapacity, the obligation is transferred to the mother as long as she has the capacity. However, a more problematic problem often arises in connection with the dissolution of family relationships, which results in the father not fulfilling his duty to maintain the children in custody, in addition to non-payment of child support. Its social, economic and psychological consequences often worsen...In order to contain such repercussions, the Algerian legislator promulgated Law No: 24-01 of 11/02/2024, which provided for specific measures for obtaining Pension (which repealed the provisions of law no.: 15-01 of 04/01/2015, which provides for the creation of the Pension fund in Algeria), the content of which I wish to clarify; The meaning of Pension in this law, the conditions and modalities for benefiting from financial rights, as well as a statement of its financial provisions.
