الإجراءات الجديدة لقمع جريمة اختلاس أموال عمومية

Abstract

جاءت هذه الدراسة للوقوف على أهم الميكانيزمات الجديدة سواء ذات الطابع العام أو الخاص لمتابعة وقمع جريمة اختلاس المال العام، سواء كانت هذه الإجراءات واردة في قانون مكافحة الفساد والوقاية منه أو في قانون الإجراءات الجزائية، أو في قوانين خاصة كل ذلك من أجل توحيد الجهود وفعاليتها في قمع الجرائم الواقعة على المال العام من خلال تجريم الاختلاس من طرف الموظف العام، وخاصة وأن تنفيذ هذه الإجراءات يتطلب وسائل وتقنيات من طرف خبراء وفنيين مؤهلين حتى يتحقق المراد من هذه الميكانيزمات، وهو محاولة الوقاية والحد من تلك الجرائم، وقد أحاط المشرع تنفيذ هذه الإجراءات بضمانات خاصة حتى لا يتم التعرض للمساس بحياة الإنسان الخاصة وحرمة سرية مراسلاته.this study is aimed at identifying the most important new mechanisms, both public and private, to monitor and suppress the crime of misappropriation of public funds, whether in the Anti-Corruption and Prevention Law or the Code of Criminal Procedure or in special laws. In the suppression of real crimes on public money through the criminalization of embezzlement by the public servant, especially that the implementation of these procedures requires the means and techniques by qualified experts and technicians to achieve the purpose of these Mechanisms is an attempt to prevent and reduce those crimes, Its special procedures guarantees are not even human exposure to prejudice the lives of the sanctity of private and confidential correspondence.
