أحكام جريمة التمييز المستحدثة في قانون العقوبات الجزائري

Abstract

تعتبر جريمة التمييز من بين الجرائم المستحدثة في قانون العقوبات الجزائري، وقد جاءت هذه الجريمة متأثرة بأحكام الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري المعتمدة سنة 1965 من قبل الجمعية العامة للأمم المتحدة، وعلى الرغم من أن الجزائر كانت من الدول السباقة في المصادقة على هذه الاتفاقية سنة 1966، وعلى الرغم من أن التمييز يمس بمبدأ المساواة الراسخ في كل دساتير الجمهورية، إلا أن تجريم التمييز والعقاب عليه لم يتأت إلا مع صدور القانون 14 – 01 المؤرخ في 04 فيفري 2014، وهو ما دفعنا للبحث في خلفية تجريم هذا الفعل والعقاب عليه في قانون العقوبات الجزائري، وهذا من خلال دراسة أركان هذه الجريمة، والوقوف على الكفاية التشريعية لنصوص التجريم والعقاب المتعلقة بجريمة التمييز عند المشرع الجزائري.Discrimination crime is considered as one of the updated crimes in the Algerian Penal law, it is affected by the provisions of the international convention to fight all sorts of discrimination which was argued in 1965 by the general association of the United Nations. Although Algeria was one of the pioneering countries in the ratification of the convention in 1966, and despite the fact that discrimination affects the principle of the equality in all the constitutions of the Republic, criminalising of the discrimination and its punishment have came only with the launch the law 14-10 dated on February,4 the 2014. This fact pushed us to study the criminalisation of this act in the Algerian Penal Code through studying the pillars of this crime, and stand on the legislation sufficiency of the criminalisation and punishment texts of this crime in the Algerian legislation.
