Abstract

تعتبر المضاربة غير المشروعة من الظواهر التي نفشت في المجتمعات نتيجة التطور الاقتصادي والاجتماعي الذي شهدته، ولمعالجة الأمر فإن المشرع الجزائري على غرار بقية التشريعات في الدول أصدر قانون خاص لها بعدما رأى بأن قواعد قانون العقوبات لم تعد قادرة على معالجتها والتصدي لها، وفي هذا الصدد سنحاول الوقوف على أهم جوانب هذه الظاهرة وهو بيان أهمية الإجراءات التي جاء بها في التصدي لها وكيفية التحري والمعاينة لهذه الجريمة الماسة بالاقتصاد الوطني والقدرة الشرائية للمستهلك.
