Abstract

إن التداخل الوثيق بين الحقوق البيئية وعدد من حقوق الإنسان يؤدي دائما إلى عرقلة هذه الحقوق الإنسانية من جراء أضرار البيئة، فحماية الحقوق البيئية من خلال القانون الدولي لحقوق الإنسان تساهم بدور كبير في بلوغ أكبر قدر من الفعالية في احترام الحقوق الإنسانية المعترف بها، غير أن وجود الاتفاقيات الدولية الخاصة بحقوق الإنسان لا تكفي بل لابد من البحث عن الآليات التي يمكن من خلالها للأفراد اللجوء إلى اللجان التعاهدية المعنية بالرقابة على اتفاقيات حقوق الانسان بغية الدفاع عن حقوقهم البيئية المعتدى عليها رفعا للضرر الواقع عليهم في هذا المجال خاصة في ظل عدم توفر الأسانيد الكافية لحماية البيئة كحق من حقوق الإنسانThe close overlap between environmental rights and a number of human rights has always impeded these human rights due to environmental damage.
