دور الضحية في وقوع جريمة القتل العمدي- دراسة وصفية تحليلية على ضحايا جرائم القتل العمدي في ولاية عنابة -

Abstract

إن مساهمة الضحية في حصول الفعل الإجرامي، بما فيها جرائم القتل العمدي لمن الأمور التي لابد من الوقوف عندها بمجرد دراسة مثل هذا النوع من الجرائم، كون أنه لا يمكن أن نشير أسهم الاتهام على المجرم القاتل فقط بل للضحية دور في وقوع هذه الجريمة، وذلك من خلال ما ترسله الضحية من اشارات أو مثيرات أو سلوكيات للجاني تكون بمثابة المنبه الذي يستثير به سلوك المجرم القاتل حيث توفر له الفرصة المواتية لتحقيق هدفه. ولقد حاولنا من خلال هذه الدراسة اجراء دراسة وصفية تحليلية على خمس ملفات متعلقة بقضايا القتل العمدي، متطرقين فيها على ضحايا القتل العمدي، مستعينين بذلك المنهج الوصفي ودراسة الحالة، وكذا على الملاحظة والوثائق، وذلك بغرض توضيح هل للضحية دور في وقوع جرائم القتل العمدي، فضلا عن تحديد كيف يكمن دورها في وقوع تلك الجرائم، وتحديد أيضا أهم الخصائص الديمغرافية والاجتماعية والاقتصادية لهؤلاء الضحايا. The victim’s contribution to the occurrence of the criminal act, including intentional homicide, is one of the matters that must be examined once a study of this type of crime is concerned, in that it is not possible to point out the accusation shares on the murderous criminal only, but the victim has a role in the occurrence of this crime And that is through what the victim sends in terms of signals, stimuli, or behaviors of the perpetrator that act as a stimulus by which the behavior of the murderer is provoked by providing him with the appropriate opportunity to achieve his goal. We have tried, through this study, to conduct a descriptive and analytical study on five files related to cases of intentional killing, touching on victims of intentional killing, using this on the descriptive approach and case study, as well as on observations and documents, with the aim of clarifying whether the victim has a role in the occurrence of intentional homicide, As well as defining how its role lies in the occurrence of these crimes, and also identifying the most important demographic, social and economic characteristics of these victims
