Abstract

تختلف مهام قضاة الحكم عن باقي القضاة وعليه يجب إعادة صياغة اليمين المهنية الموجهة إليهم بحيث تعكس مهامهم بدلاً من الصيغة الموحدة التي يؤدونها جميعاً بمناسبة تعيينهم أول مرة، كما يجب إعادة النظر في إجراءات أدائها بحيث يحلف القاضي اليمين في جلسة علنية أمام المتقاضين سواء أول مرة أو بصورة دورية، لما يفترض أن يزيد ذلك في تحسيس القاضي بحجم مسؤولياته ويعزز ثقة المتقاضين في القضاء، بدلاً من جلسة احتفالية مغلقة. The functions of magistrate Judges, differs from other judges. Therefore, , it is necessary to see again the formula of the oath to pronounce by each of the judges to answer in a significant way the role assigned to each of them, rather than a cammon oath of which is generally pronounced in by all, during their names in their respective posts for the first time. It is also necessary to revise the condition in which this oath is prete. It would be interesting to see the judge Pronouncing it in plenary session, first time or in a periodic way, this could result positive impressions, with greatness of its responsability and with better influence at the citizens in them, better behind closed doors.
