اعتبار قاعدة المآل في فتاوى المالكية من خلال الدرر المكنونة في نوازل مازونة لأبي زكريا يحيى بن موسى المغيلي المازوني التلمساني (ت 883هـ - 1478م)

Abstract

تعرِض هذه الدراسة لمفهوم قاعدة اعتبار المآل وعلاقاتها بفقه النوازل، وبيان أثر اعتبارها في الفتاوى، مع ذكر ضوابطها ومراتبها، من خلال مسائل تطبيقية مستقرأة من كتاب الدرر المكنونة للإمام المازوني؛ الذي هو أحد مصادر فقه النّوازل عند المالكية، وذلك لتبْيين مدى احتياجنا إلى قاعدة النظر في المآل في تنزيل الأحكام على الواقع والوصول إلى تقارب الآراء والتقليل من الخلاف؛ إظهارا لمرونة الشريعة، وسعة آفاق الاجتهاد فيها، وبيان صلاحية الإسلام لكل زمان ومكان.

This study presents the concept of the rule of considering the consequence and its relations with the jurisprudence of calamities, and explaining the impact of its consideration in the fatwa with a mention of its controls and ranks through practical issues extracted from the book Al-Durar Al-Maknounah By Imam Al-Mazouni, which is one of the sources of the jurisprudence of calamities according to the Malikis .And this is in order to show to what extent we need the rule of considering the consequence in projecting judgments on reality, reaching a convergence of opinions and minimizing disagreements; to demonstrate the flexibility of Sharia, the broad horizons of Ijtihad, and to prove the validity of Islam for every time and place.
