أثر الاستحسان في إيجاد البديل الفقهي المعاصر

Abstract

الملخص: تسعى هذه الورقة إلى بيان العلاقة بين قاعدة الاستحسان الأصولية والبديل الفقهي المعاصر، وذلك من خلال الكشف عن مدى أثر الاستحسان في إيجاد ومشروعية هذا البديل الفقهي المعاصر، ويكون ذلك من خلال بيان صلة الإستحسان بالأصول والمبادئ التي تقوم عليها مختلف البدائل الفقهية وخاصة المعاصرة منها، ولقد تم التوصل من خلال هذا البحث إلى أن للاستحسان دور فعاّل وأثر قوي على مشروعية الكثير من البدائل المعاصرة، وهذا من شأنه إظهار جانب مهم من جوانب يسر الشريعة وسعتها ومرونتها والتي ما رأت البشرية ولا سمعت ولا علمت، بمنهج أيسر ولا أرحم ولا أرفق بإتباعه من هذه الشريعة السمحاء ومن هذا المنهج . : Abstract: This paper aims to explain the relation between the fundamental principle of juristic preference equity and the juristic contemporary substitute , so we have showed the role of equity in finding and légalising this juristic contemporary substitute ,and explained the link between equity and the principles of different juristic substitutes especially contemporary ones. In the end of our study we found that equity plays an important role and a deep effect in legalising of many contemporary substitutes which improve softness and flexibility of Islamic law that’s one of the most tolerant and merciful laws ever.
