آلية التصريح بالممتلكات للوقاية من الفساد ومكافحته في التشريع الجزائري مقارنا بالتشريع التونسي

Abstract

التصريح بالممتلكات آلية من الآليات التي نص عليها التشريع الجزائري وغيره من التشريعات المقارنة وذلك لضمان الشفافية في الشؤون العمومية، وحماية الممتلكات العمومية وصون نزاهة الأشخاص المكلفين بخدمة عمومية، فما مدى فاعلية هذه الآلية في الوقاية من الفساد ومكافحته، في ظل القانون الذي جاء بها والنصوص المطبقة له، وذلك من ناحية الأشخاص المعنيين بالتصريح بالممتلكات ووضعياتهم، وكذا الجهة التي يتم الإكتتاب أمامها التصريح، ومن ناحية العقوبات المقررة لمخالفة واجب التصريح، مقارنا ذلك كله بالتشريع التونسي بغية الوقوف عند أبرز الفروقات الموجودة بين التشريعين، وبالتالي الاستفادة من الكيفية السليمة والفعالة في تطبيق هذه الآلية الدستورية لتعزيز مبدأ الحكم الراشد لدى الدول المغاربية The declaration of property is one of the mechanisms stipulated by Algerian legislation and other comparative legislation to ensure transparency in public affairs, and the protection of public property and safeguard the integrity of the persons in charge of public service, so what is the effectiveness of this mechanism in preventing and control corruption ? And therefore in accordance with the law and the applicable texts . and in terms of the persons concerned with the declaration of property and their status, as well as the entity under which the authorization is being issued, and in terms of the penalties for violating the duty of declaration Comparing all this with Tunisian legislation in order to stand at the most prominent differences between the two legislations, and thus benefit from the proper and effective way in applying this constitutional mechanism to promote the principle of good governance in the Maghreb countries.
