دور وكيل الجمهورية في المصالحة والوساطة الجنائية في التشريع الجزائري

Abstract

تعرف السياسة الجنائية إصلاحات عميقة تماشيا مع تطور المجتمعات، وزيادة الوعي الثقافي والحضاري واتساع مجال الحقوق والحريات. أدى إلى ظهور آليات بديلة عن الدعوى العمومية أسندت في التشريع الجزائري إلى وكيل الجمهورية. وقد تناول البحث المصالحة في المادة الجزائية في مجال المخالفات التنظيمية والمرورية، والتي مرة بعدة مراحل من الاجازة إلى التحريم إلى الاجازة. كما تناول البحث الوساطة كنظام جديد في بعض الجنح والمخالفات جاءت بها تعديلات قانون الاجراءات الجزائية بالأمر 15-02 الصادر في 23 جويلية 2015، كإحدى البدائل المستحدثة وشروط تطبيقها والآثار القانونية المترتبة عنها. Criminal policy has seen profound reforms in line with the development of societies, increased cultural and civilizational awareness and the breadth of rights and freedoms.Which led to the emergence of alternative mechanisms for public prosecution, which in Algerian legislation was delegated to the General attorney in this research. The research dealt with reconciliation in the Penal Code in the field of regulatory and traffic irregularities, which once in several stages from the Permissibility to prohibition to Permissibility. The research also dealt with the mediation as a new system in some misdemeanors and irregularities brought by the amendments of the Code of Criminal Procedure Order 15-02 of 23 July 2015, as one of the new alternatives and the conditions of their application and the legal implications thereof.
