الإطار القانوني للشراكة بين القطاع العام والخاص في التشريع الجزائري دراسة مقارنة

Abstract

تعتبر الشراكة بين القطاعين العام والخاص إحدى أهم الآليات الحديثة في حل مشكلة تمويل المشاريع الكبرى في ظل قصور الجهات التمويلية وتنامي الحاجيات الأساسية للجهات الحكومية، وبموجب هذه الدراسة ستتم إزالة اللبس عن مصطلح الشراكة من خلال تحديد التعريف اللغوي وكذا التعريف الاصطلاحي من خلال تحديد مفهوم فقهي وتشريعي وارد في مختلف الدول، وكذا تعريف دولي، ثم التركيز على الطبيعة القانونية لعقود الشراكة بين القطاعين من خلال التكييف القانوني ثم الآثار المترتبة عن تحديد الطبيعة القانونية لعقود الشراكة بين القطاعين العام والخاص. لتخلص الدراسة لتحديد مدى مساهمة عقود الشراكة بين القطاعين العام والخاص رغم الصعوبات والعوائق التي تعترض تنفيذها إلى أنها أداة فعالة مساهمة في تقليص نفقات الدولة، كونها تعزز الخبرات بين القطاعين مم يسمح بخلق بيئة مستقرة تنتج اقتصاد قوي. The partnership between the public and private sectors is one of the most important modern mechanisms in solving the problem of financing major projects in light of the shortcomings of the financing agencies and the growing basic needs of government agencies. It is included in various countries, as well as an international definition, then focus on the legal nature of partnership contracts between the two sectors through legal adaptation and then the implications of determining the legal nature of partnership contracts between the public and private sectors. The study concludes to determine the extent of the contribution of partnership contracts between the public and private sectors, despite the difficulties and obstacles to their implementation, that it is an effective tool that contributes to reducing state expenditures, as it enhances experiences between the two sectors, allowing the creation of a stable environment that produces a strong economy.
