حماية التنوع البيولوجي في الشريعة الإسلامية

Abstract

جاءت الشريعة الإسلامية بمنهج شامل لرعاية البيئة، يقوم على أسس فكرية وعقدية متينة، تضمن حسن تعامل الإنسان مع الكائنات الأخرى ومع كل مكونات التنوع البيولوجي، باعتبارها أمانة يجب صونها، عكس النظريات الوضعية، التي أطلقت العنان لقدرات الإنسان، فتسبب في تدمير النظم البيئية وانقراض عدد هائل من الأصناف، كنظرية مركزية الإنسان، والنظرية التقليدية للتنمية. ورغم التأثير المحدود للنشاطات البشرية على النظم البيئية والتنوع البيولوجي في الماضي، إلا أن الشريعة الإسلامية قد انتبهت إلى ضرورة حمايته، وانتهجت لهذا الغرض، تدابير وأساليب لم تتوصل إليها التشريعات الوضعية إلا في العصر الحديث، كما أنها وضعت حلولا للإشكالات التي تواجه التشريعات الحديثة في مجال جبر الأضرار التي تلحقها النشاطات البشرية بمكونات هذا التنوع. The Islamic Shari'ah came with a comprehensive approach for environmental protection, based on solid intellectual and ideological foundations that ensure the good treatment and behavior of human beings towards the other organisms and all the biological diversity components, as a trust that must be preserved, contrary to the positivist theories, that unleashed human abilities, causing the destruction of the ecosystems and the extinction of a huge number of species, such as the Central Human Theory and the Traditional Theory of Development. And in spite of the limited impact of human activities on the ecosystems and the biodiversity in the past, Islamic law has recognized the need to protect them, so it has adopted measures and methods for this purpose that haven’t been applied by positivist legislation until the modern era. It has also developed solutions to the problems facing modern legislations in the field of repairing the damage caused by human activities to the components of this diversity.
