القـوة الإلـزاميـة للتـدابيـر المـؤقتـة لمحـكمـة العـدل الـدوليـة

Abstract

من المسائل التي لها علاقة بتنفيذ أحكام محكمة العدل الدولية والتي اختلفت حولها الآراء، مسألة تنفيذ الأوامر التي تصدرها المحكمة، وبصفة خاصة الأمر بالتدابير المؤقتة للحماية، ويتعلق هذا الاختلاف بمسألتي القوة الإلزامية لتلك الأوامر ومدى دخولها في نطاق المادة 94-2 من ميثاق الأمم المتحدة، وساعد على هذا الاختلاف الفقهي نقص السوابق رغم وفرة هذا النوع من الأوامر. وتمثل التدابير المؤقتة أحد أهم الإجراءات العارضة أمام محكمة العدل الدولية وتزداد أهمية التدابير المؤقتة مع ازدياد التقاضي أمام محكمة العدل الدولية باعتبارها أحد أهم وسائل التسوية السلمية للمنازعات الدولية، وتتناول الدراسة إلزامية الامتثال لهذه التدابير من خلال وجهة نظر الفقه الدولي وبعض ممارسات محكمة العدل الدولية. One issue that is related to the Execution of the International Court of Justice judgments and about which opinions differed is the Execution of the orders rendered by the Court, in particular the temporary measures of protection. This difference is attributed to the question of the obligatory force of such orders and the extent of their entry into Article 94.2 of the United Nations Charter, the lack of precedents accentuated this jurisprudential difference despite the availableness of this kind of orders. the temporary measures represent one of most important measures before the International Court of Justice, this importance is due to the rising litigation before the International Court of Justice Considering that it is one of the most important means of peaceful resolution of international disputes. This study tackles the obligatory compliance with these measures through the international jurisprudence viewpoint and through some practices of the International Court of Justice.
