الإعلان عن الصفقات العمومية بين حماية مبدأ المنافسة الحرة والحد من ظاهرة الفساد الإداري - دراسة مقارنة -

Abstract

نهدف من خلال هذه الدراسة إلى إبراز الدور الفعال الذي يلعبه الإعلان عن الصفقة العمومية في حماية مبدأ المنافسة الحرة ومكافحة الفساد المتعلق بالصفقات العمومية، كون أن إعلام جميع المتنافسين الراغبين في الصفقة لإيداع عروضهم وكذا الجمهور يعتبر جوابا لمتطلبات العلانية والشفافية والمساواة، وبالتالي الإستغلال العقلاني للمال العام، فمنح الصفقة للمتعامل الإقتصادي الأحسن من بين المتعاملين الآخرين سيؤدي حتما للإبتعاد عن كل أشكال الفساد المتعلق بالصفقات العمومية، ولمعرفة مدى فعالية الإعلان في حماية مبدأ المنافسة ومكافحة الفساد الإداري في الجزائر خاصة قمنا بقراءة في تشريعات كل من تونس والمغرب ودولة الإمارات العربية المتحدة المنظمة للصفقات العمومية سعيا منا للوقوف على أبرز النقائص ومحاولة معالجتها. We want in this study to show the effective role which play the advertising in the public transactions to protect the principale of free competition and fight against corruption which related with the public transactions informing all the contestants wishing in the deal to deposit their shows and the public also is a answer to the over requirements and transparency and equality. Therefore, it must the rational exploitation of the public money giving the deal to the good economic operator,the result will be inevitably stay away to any corruption which related with the public transactions. When we want discovered how effective the advertisement in the protecting in the principale of competition and fight against corruption and fight against corruption administrative in Algéria and specially we studied legislation in Tunisia , Marocco and UAE which organized the public transactions. All this studies to discover deficiencies and try to address them.
