التعاقد الإلكتروني في مجال الصفقات العمومية

Abstract

التعامل الإلكتروني حتمية فرضها الواقع المعاش بفعل التطور العلمي والتكنولوجي، فالتعامل الإلكتروني له أهداف منها تسريع انجاز الصفقة وتفادي كل الصعوبات المعترضة ميدانيا، فإشكالية الدراسة تتمحور حول مدى فاعلية النصوص التشريعية في مجال الصفقات العمومية ودورها في ترقية التعامل الإلكتروني. لذا حاولنا تسليط الضوء على عملية التحول من التعاقد الكلاسيكي التقليدي إلى التعاقد الإلكتروني في مجال الصفقات وصورة هذا التحول من خلال استخدام نظام البوابة الإلكترونية، أما عن النتائج المستخلصة فتمثلت في وجود جهود وطنية في تطوير المنظومة التشريعية في هذا المجال والدور الذي تلعبه وستلعبه البوابة الإلكترونية في جلب الاستثمارات الوطنية والاجنبية.Electronic dealing is an imperative imposed by reality, due to scientific and technological development. The electronic transaction has goals, including speeding up the completion of the procurement and avoiding obstacles encountered on the ground, the study revolves around the extent of the effectiveness of legislative texts in promoting electronic transactions. We focus on the process of shifting from traditional to electronic contracting and the image of this transformation through the electronic portal system. And we concluded that there is a national efforts in developing the legislative system. in this area and the role it plays the electronic portal in attracting investments.
