    أثر الإثبات الجزائي بالبصمــة الوراثيـــة على الحريــة الفرديـة

    إن التطور العلمي أحدث ثورة في مجال علم الأدلة، ويتجلى ذلك في علم البصمات الذي لم يعد يقتصر على بصمات أصابع اليد بل تعداه إلى بصمات أخرى، كبصمة العين والأذن والصوت وغيرها، وقد اصبحت البصمة الوراثية من أبرز الأدلة العلمية التي تؤدي إلى التعرف على هوية الاشخاص ومعرفة مرتكبي الجرائم. والمشرع الجزائري بإصداره للقانون 16-03 المتعلق باستعمال البصمة الوراثية في الإجراءات القضائية والتعرف على الأشخاص، قد واكب التطور العلمي لأجل استفادة السلطة القضائية منه في التصدي للجريمة، ونظرا لأهمية استخدام البصمة الوراثية دليلا علميا في الاثبات الجزائي فقد أحاطها المشرع الجزائري بقيود الشرعية الجزائية حماية لحقوق الانسان وحريته الشخصية، قصد إحداث التوازن بين مصلحة المجتمع ومصلحة الفرد.Scientific development has revolutionized the field of forensic evidence, thus has been reflected in DNA fingerprinting which is no longer limited to hand fingerprints, but transcends to iris scan, ear recognition (outer ear), sound (voice) recognition, and others. Undoubtedly, DNA fingerprinting has become one of the most important scientific evidence leading to the recognition of persons' identity and criminals'. In fact, by issuing Law N16-03 on the use of DNA in judicial proceedings and identification of persons, the Algerian legislator has moved forward by coping with scientific developments through allowing the judicial power to benefit from that technique in terms of dealing with any crime. Considering the importance of using DNA as a scientific evidence in forensics, the legislator has sought, through regulations of penal legitimacy, to protect human rights and personal freedom, and ensure a proper balance between the interests of society and those of the individual.

    تأثير استخدام البصمة الوراثية في الإثبات الجزائي على الحقوق والحريات

    نظرا للمميزات العلمية الدقيقة التي تتسم بها البصمة الوراثية واختلافها بين كل البشر جعلتها من أبرز وأنجع التقنيات التي وجدت تطبيقا سريعا في مجال علم الإجرام والتحقيق الجنائي كدليل لا يقبل فيه الشك، غير أن استعمال هذه التقنية في مجال الإثبات الجنائي قد خلق تضارب بين مصلحتين، تكمن الأولى في مصلحة المجتمع العام والحفاظ على أمنه واستقراره، في حين أن الثانية تتمثل في مصلحة الأفراد وحماية حقوقهم وحرياتهم الخاصة، التي يمكن أن تتأثر باستعمال هذه التقنية، وهذا ما سعينا إلى إبرازه، كما سلطنا الضوء على أهم الضوابط الهادفة للموازنة بين هاتين المصلحتين والتي وضعتها التشريعات التي أجازت استخدام تقنية الحمض النووي في الإثبات الجزائي، فضلا عن البحث في مدى مشروعيتها.The precise scientific features ofgenetic imprint made it a prominent and effective technique of proof that found a fast application in the field of criminology and criminal investigations as undoubtable evidence, but the use of this technique in the field of criminal evidence has created a conflict of two interests, the first is the interest of general community and the preservation of its security and stability, while the second is the interest of individuals and the protection of their special rights and freedoms that may be affected by the use of this technique.
