    يعتبر تحرير الأسواق وإخضاعها لقواعد المنافسة الحرة متعارضا في الكثير من الأحيان مع رغبةالمؤسسات الاقتصاديةفي تحقيق أهدافها الربحية وفرض سيطرتها في السوق، ولهذاالسبب ظهرت الاتفاقات المقيدة للمنافسة كحل فعال لتحقيق غاية السيطرة والحد من مزاحمة المنافسين، هدف الدراسة لتسليط الضوء على نسبية حظر هذه الاتفاقات من الناحية التشريعية والقضائية، ذلك أن السوق في حاجة إلى نظام اقتصادي عام جديد يحمي المنافسة والتي يجب أن تكون خاضعة للرقابة ومحلاًّ للضبط والعدالة، كما انه في حاجة من ناحية أخرى إلى قواعد قانونية حامية للحرية التعاقدية والتطور الاقتصادي والاجتماعي على حد سواء.The liberalization of markets and their free competition rules are often incompatible with the desire of economic institutions to achieve their profitability objectives and to impose their control in the mark, The study aims at highlighting the relative prohibition of these agreements from the legislative and the judicial point of view, as the market needs a new general economic system that protects competition, which must be subject to censorship As well as on the other hand, to legal rules protecting contractual freedom, And economic and social development alike.
