    حماية العون الاقتصادي في إطار دعوى المنافسة غير المشروعة

    يشكل موضوع دعوى المنافسة غير المشروعة كآلية مدنية لحماية العون الاقتصادي من كافة أشكال المنافسة غير النزيهة موضوع ذو أهمية، خاصة وأن اتجاه المشرع الجزائري إلى الانفتاح الاقتصادي دعمه بجملة من النصوص التشريعية المتتالية وتعديلاتها بهدف الوصول إلى الحماية اللازمة للعون الاقتصادي. فإصدار النصوص القانونية في أي دولة ليس له أي مدلول إذا لم يتوصل المشرع إلى التوفيق بين أهداف المنافسة وحماية العون الاقتصادي، رغم فعالية دعوى المنافسة الغير مشروعة كآلية مدنية لحماية العون الاقتصادي إلا أنها بقيت قاصرة في بعض الأحيان عن تعويض الضرر. The topic of the unfair competition lawsuit as a civil mechanism to protect economic aid from all forms of unfair competition is an important topic, especially since the Algerian legislator’s tendency to economic openness was supported by a number of successive legislative texts and their amendments in order to reach the necessary protection for economic aid. The issuance of legal texts in any country has no meaning if the legislator did not reach a compromise between the objectives of competition and the protection of economic aid, despite the effectiveness of the unfair competition lawsuit as a civil mechanism for the protection of economic aid, but it remained insufficient in some cases to compensate for the damage.

    حماية نشاط العون الإقتصادي في ظل مبدأ حرية المنافسة

    يهدف الأمر رقم 03/03 إلى تنظيم المنافسة في السوق والعمل على الحد من مختلف التجاوزات التي يمارسها العون الإقتصادي في السوق بهدف الإضرار بالغير عن طريق مجموعة من الممارسات التي تقيد المنافسة، لذا فقد نظم المشرع المنافسة عن طريق سن الأمر رقم 03/03، بهدف الحد ومنع كل الممارسات المقيدة للمنافسة وكذا مراقبة كل التجميعات الإقتصادية التي من شأنها إحداث خلل في السوق، بهدف حماية العون الإقتصادي. Ordinance No. 03/03 aims to regulate competition in the market and work to limit the various abuses practiced by the economic aid in the market with the aim of harming others through a set of practices that restrict competition. Limiting and preventing all practices restricting competition, as well as monitoring all economic aggregates that may cause market disruption, with the aim of protecting economic aid.

    مفهوم الأنشطة الاقتصادية وأنواعها

    لقد حدد المشرع الجزائري مجموعة كبيرة من الأنشطة الاقتصادية التي تمارس في السوق من قبل الأعوان الاقتصاديين التي يتعين تسجيلها في السجل التجاري كإجراء لتنظيم ممارستها بصورة قانونية في إطار المنافسة الحرة والنزيهة وذلك من خلال مدونة الأنشطة الاقتصادية التي تعتبر من أهم الأدوات القانونية التي تدخل في تسيير النظام القانوني للسجل التجاري والتي تعرض بدقة النشاطات التجارية والاقتصادية التي تستوجب ممارستها القيد في السجل التجاري، حيث تم تقسيم هذه الأنشطة ضمن ثلاث فئات: الإنتاج، التوزيع والخدمات بالإضافة لأنشطة اقتصادية مستحدثة كنشاطات الاستيراد والصناعات التقليدية الحرفية والصيد البحري، الصفقات العمومية والتجارة الالكترونية. The Algerian legislator has identified a wide range of economic activities that are practiced in the market by economic agents that must be registered in the commercial registry as a measure to regulate their legal practice within the framework of free and fair competition, through the Code of Economic Activities, which is one of the most important legal tools that enter into the running of the system The legal commercial register, which accurately displays the commercial and economic activities that require registration in the commercial register, where these activities were divided into three categories: production, distribution and services in addition to new economic activities such as import activities, traditional handicrafts and fishing, public deals and electronic commerce.
