محاولة تجديدية في تصنيف الأدوات التفسيرية

ملخص: تهدف هذه الدراسة إلى بيان أهمية أدوات التفسير التي تعددت حولها اصطلاحات المصنفين، لكونها علوما لازمة التحصيل لممارسة العملية التفسيرية. وقد بيّن البحث كيف أن استخدام مصطلح الأدوات يمكنه الإسهام في حل العديد من المشكلات التي تشغل العقل التفسيري بصفة خاصة، والعقل المسلم عامة. من ذلك إشكالية النقل والعقل، وثنائية التفسير والتأويل، وقضية التفسير بالرأي المذموم. ثم استعرض البحث أهم تقسيمات أدوات التفسير عند القدامى والمحدثين؛ فمن القدامى تميز تقسيم كل من أبي حيان الأندلسي الذي يعد المؤسس الفعلي للحديث عن الأدوات، والزركشي والغزالي والسيوطي والشاطبي. أما المحدثون فأبرزهم ابن عاشور ومحمد رشيد رضا والإبراهيمي ومحمد باقر الصدر والأبياري. لتخلص الدراسة في الأخير إلى تقسيم جديد لأدوات التفسير، من جانبين: الوجود والعدم. أ- فمن جانب الوجود هناك ثلاثة أصناف من الأدوات: 1- قبليات معرفية تشمل المعارف التفسيرية والشرعية والتاريخية والكونية والإنسانية. 2- وسائط منهجية تتمثل في معرفة مناهج المفسرين وحسن استخدامها وتوظيفها وتبني نتائج ذلك. 3- قابليات ذاتية تشمل المواهب العقلية والنفسية والقرآنية والواقعية مع خلفية المفسر. ب- أما من جانب العدم، فيجب على المفسر ترك شواغل العبادة ومفسدات الأرواح ومكدرات النفوس والعقول. Summary This study aims to clarify the importance of the tafsir’ tolls, which had been widely discussed in several studies, as an obligatory tool to explain the holy Quran. Using the concept of tools will help to solve some problems of tafsir. This study presented several views about tools. The classical views pointed the linguistic tools, starting by Abu hayan’s view, summarised later by Ezerkashi and followed by the others, without forgetting the views of Essoyouti and Elghazali and Eshatibi.The modern views were more précised, such as: Ibn Ashur, Rashid Ridha, Elibrahimi, bakir essadr, and elabyari. This research proposed a new classification to the tools of tafsir: a-The founding tools; 1-The preliminary sciences. 2-The methodological tools. 3-The personal abilities. b-The preventing tools; which is letting the sins that trouble the tafsir ability.
البعد الزماني والمكاني وأثرهما في فهم السنة عند الصحابة

ملخص: إن حسن فهم نصوص السنة النبوية أمر ضروري ليستقيم الفكر والعمل والمنهج، وأما سوء فهمها أو سوء تأويلها. فقد أوقع بعض المسلمين في الانحراف والابتعاد عن جادة الصواب، فظهرت الفرق الضالة والمبتدعة بما تمثله من خطر عظيم على المنهج النبوي، بسبب النظرة القاصرة للنصوص وحصرها في بعض المظاهر والشكليات، وعليه فمن واجب المسلمين أن يعرفوا كيف يحسنون فهم هذه السنة النبوية، وكيف يتعاملون معها فقها وسلوكا، أسوتهم وقدوتهم في ذلك الصحابة –رضوان الله عليهم-؛ الذين لم يقتصروا على الفهم الحرفي للحديث أو الفهم البسيط الذي يغفل الواقع، بل اعتمدوا على ضوابط علمية تعينهم على فهم النص النبوي، ومن بينها ضابط البعد الزماني والمكاني في إزالة الإشكال عن النص. ولذلك جاءت هذه الدراسة «البعد الزماني والمكاني وأثرهما في فهم السنة النبوية عند الصحابة -رضوان الله عليهم-» كمحاولة لبيان أثر البعدين في فهم السنة النبوية. ABSTRACT: The good understanding of the Sunnah is the important pillar for the straightness of the way of thinking, the work, and the behavior. On the other hand, its misunderstanding or its misinterpretation by some Muslims has created a distance and caused their deviation from reason, which consequently led to the emergence of heterodox and disoriented groups. These groups represent a real danger on the principles of the prophet since they have just a limited perception of texts based only on certain aspects and forms. Muslims should, therefore, improve their understanding of the Sunnah of the Prophet by respecting the Fiqh and the rules of behavior, and by following and imitating the Prophet’s companions who avoided the literal and simple interpretation of the Hadith. The companions adopted scientific norms to help them understanding correctly the Prophet’s texts, among which the norm of place and time dimension when raising ambiguity on a text. Our study is therefore entitled “Time and place dimensions and their effects on Sunnah understanding by the companions”.
هجرة الأسر الريفية ونمو العشوائيات الحضرية في الجزائر

الملخص: شهد المجتمع الجزائري خلال الفترة الأخيرة شكلا من عدم الاستقرار الاجتماعي خصوصا بالريف، الأمر الذي زاد من حدة هجرة الأسر الريفية تجاه المدن المستقرة نسبيا. أدى هذا السيل الكبير للمهاجرين إلى خلق مشكلات عدة على مستوى المدينة، لعل أبرزها اهتزاز النسيج العمراني، بنمو العشوائيات الحضرية، فساهمت الهجرة غير المنتظمة للأسر الجزائرية تجاه المدن إلى زيادة وتكاثر الأحياء الهامشية والفوضوية، هذا ما أدى إلى ظهور الكثير من الآفات الاجتماعية والاقتصادية والبيئية. يتناول المقال العلاقة الموجودة بين هجرة الأسر الريفية تجاه المدن في الجزائر ونمو العشوائيات الحضرية. ABSTRACT Algerian society witnessed during the recent form of social stability, especially in rural areas, which increased in the migration of rural families to cities relatively stable. This large influx of migrants to create several problems at the city level, perhaps the most notable being that shook the urban fabric, the growth of urban slums, which contributed to the migration of others regularly to the families of Algerian cities to increase and the proliferation of marginal neighbourhoods and anarchism, which led to the emergence of many social ills, economic and environmental. Article deals with the relationship between the migration of rural families to cities in Algeria and the growth of urban slums.
افتتاحية العدد: شروط ضرورية في كتابة ونشر المقالات العلمية

دور مؤسسات التعليم العالي العربية في تنمية مفهوم المواطنة لدى طلابها لمواجهة تحديات العولمة الثقافية: دراسة تحليلية

الملخص: تعتبر قضية المواطنة من القضايا المهمة التي تركز عليها الدولة الحديثة، لاسيما في ظل العولمة الثقافية التي تفرض كثيرا من التحديات في وجه المحافظة على مفهوم المواطنة وتنميته لدى فئة الشباب في المجتمعات المعاصرة، ومنها بالطبع المجتمعات العربية. وهدفت الدراسة الحالية إلى تأكيد وتبرير حاجة المجتمعات العربية المعاصرة إلى تنمية مفهوم المواطنة لدى الشباب العربي، وهدفت أيضا إلى تحليل الدور الذي يمكن أن تقوم به مؤسسات التعليم العالي العربية في مجال تنمية مفهوم المواطنة لدى طلابها لمواجهة تحديات العولمة الثقافية. استخدمت الدراسة الحالية المنهج الوصفي التحليلي للإجابة عن تساؤلاتها، من خلال تتبع الإطار النظري المتعلق بالمواطنة والعولمة الثقافية ودور مؤسسات التعليم العالي في تنمية المواطنة لدى طلابها، وتحليله في ضوء نتائج الدراسات ذات العلاقة المباشرة، وواقع المجتمعات العربية المعاصرة حول هذا الشأن. وتم التوصل إلى مجموعة من الاستنتاجات التي تؤكد ضرورة قيام مؤسسات التعليم العالي العربية بدورها المنوط بها في مجال تنمية مفهوم المواطنة لدى طلابها، وإكسابهم قيم المواطنة الحضارية. كما اقترحت الدراسة جملة من التوصيات التي يمكن أن تفعّل هذا الدور لدعم جهود الدول العربية في سبيل تنمية المواطنة لدى شبابها بما يكفل لهم التعامل بإيجابية ونقد بناء مع تحديات العولمة الثقافية. Abstract: The issue of citizenship is one of the important issues that fousses in the modern state, especially in light of cultural globalization, which imposes a lot of challenges in the face of maintaining the concept of citizenship and development of young people in contemporary societies, including - of course - the Arab societies. The aim of the present study was to confirm and justify the need of contemporary Arab societies to the development of the concept of citizenship among Arab youth, and also aimed to analyze the role that can be played by higher education institutions in the development of the Arab concept of citizenship among its students to face the challenges of cultural globalization. This study used the descriptive analytical method to answer its questions, by tracking the theoretical framework on citizenship and cultural globalization and the role of higher education institutions in the development of citizenship among its students. All that was analyzed in the light of the results of related studies, and the reality of contemporary Arab societies on this matter. This research reached a set of conclusions emphasize the need for the role of arabic higher education institutions in developing the concept of among its students, and equip them with the values of civilization citizenship. The study also suggested a number of recommendations that can support the efforts of the Arab countries to develop citizenship among young people, so as to ensure them to deal positively using a constructive criticism, with the challenges of cultural globalization.
أثر اقتصاد المعرفة على الاقتصاد الإسلامي

ملخص: يتمثل الهدف الأساس من هذا المقال في توضيح مختلف آثار اقتصاد المعرفة، كنمط تكنو– اقتصادي جديد قائم على الاستخدام واسع النطاق للمعلوماتية وشبكات الإنترنت، على مختلف نشاطات وتطبيقات الاقتصاد الإسلامي. لقد بينت هذه الدراسة أن تأثيرات اقتصاد المعرفة لم تقتصر على تطوير طرق جديدة وسريعة جدا للبحث الإلكتروني، عبر محركات بحث، تعتبر بمثابة فهارس أو بوابات، يستعملها جميع مستخدمي الإنترنت Internet، يمكنها توضيح كل ما يتعلق بالاقتصاد الإسلامي، في كل وقت، ولأي شخص، بل توسعت إلى الاستفادة من بقية آليات وقنوات هذا النمط الاقتصادي المعرفي الجديد، على غرار الأنترانات Intranet والإكسترانات Extranet التي تربط البنوك وشركات التأمين الإسلامية فيما بينها. كما أوضح هذا البحث أيضا في نهاية المطاف لرواد تسويق مزايا الاقتصاد الإسلامي لشبكة العلاقات الاقتصادية محليا وعالميا، وتحيينها باستمرار، عبر الاتصال السريع والسهل بكل الأعوان الاقتصاديين مباشرة عبر بريدهم الإلكتروني Email، أو عبر مواقع التواصل الاجتماعي Facebook أوTwitter . Abstract: The main objective of this article is to clarify the different effects of the knowledge economy, as a new techno-economic style, based on the widespread use of information and the networks of Internet, on the several activities and applications of Islamic economy. This study had shown that the effects of the knowledge economy wasn’t limited to the development of new and very quick methods to electronic search, via search engines, considered as indexes or gates, used by all Internet users, which can explain everything related to Islamic economics, all the time, and for any person, but they expanded to take advantage of the rest of the mechanisms and channels of this new economic cognitive style, similar to Intranet for secret transactions and Extranet for connecting Islamic banks and insurance companies among them. Finally, this research had also clarified for the leaders of the Islamic economics advantages’ marketing must intensified their economic relations network, both locally and globally, and constantly updating, via quick and easy contact with all economic agents directly via their E-mail, or via social networking sites facebook or twitter.
المؤشرات السلوكية المميزة للتلاميذ ذوي صعوبات التعلم في المرحلة الابتدائية

مــلـخـص: يكشف هذا المقال عن أهم المظاهر السلوكية التي يتميز بها التلاميذ ذوو صعوبات التعلم في المرحلة الابتدائية، حيث أبرزت فيه أهم التصنيفات الموضوعة من طرف هيئة العلماء في هذا المجال، كما تطرقت إلى صعوبات التعلم النمائية، وصعوبات التعلم الأكاديمية مع بيان العلاقة بينهما. آملين أن يزود هذا المقال المهتمين بهذا المجال بالمعايير التي تساعدهم على الكشف المبكّر عن التلاميذ الذين يعانون من صعوبات التعلم. Résumé: L’objectif de cet article est la présentation des importantes caractéristiques comportementales chez les élèves de l’enseignement primaire qui souffrent des difficultés d’apprentissage. L’article aborde aussi les classifications principales de ce trouble évoquées par la communauté scientifique ; soit les difficultés développementales ou académiques d’apprentissage et le lien existant entre ces deux types de difficultés. On espère que le présent article fournit aux gens qui s’intéressent à ce domaine les critères qui les aident à la découverte précoce des élèves qui souffrent des difficultés d’apprentissage.
الثقافة التنظيمية في المجتمع الجزائري بين الأطر التقليدية والنماذج الحديثة

ملخص: يتناول هذا البحث موضوعا في غاية من الأهمية يتعلق بالثقافة التنظيمية في المؤسسة والمجتمع الجزائري، وتتمحور إشكاليته في تحليل ظاهرة التناقض في هذه الثقافة التي شكلت العبء الأكبر لتجاوز المؤسسات الجزائرية لمشكلاتها، وتحقيق أهدافها، فهذه الثقافة يتجاذبها أنماط تنظيمية تقليدية منبثقة عن المجتمع التقليدي، وما ينطوي عليه من قيم وأعراف ونظم، ومن جهة أخرى نماذج تنظيمية حديثة يصعب عليها التوطن على أنقاض هذه الثقافة (التقليدية) التي لا تزال تتربع على المخيال الاجتماعي والثقافي للإنسان الجزائري، فهذا المقال محاولة لتفكيك هذه المعضلة وتنبيه إلى خطورتها على المؤسسة والمجتمع. Abstract: This article is talking about a very important topic which is related to organizational culture in the Algerian institution and society. The problematic of this topic is the analysis of the contradiction phenomenon in this culture that formed the greatest burden for the Algerian institutions to overcome their problems , and achieve their goals, this culture is buffeted by organizational traditional patterns that emanated from the traditional society, and what it carries of values and norms, and systems, on the other hand modern organizational models find it difficult for them to settle on the ruins of this culture (traditional), which still resides in the social and cultural imagination of the Algerian person, this article is an attempt to dismantle this dilemma and alert to the danger that faces the institution and the community.
Exploration Des Compétences Nécessaires à L’activité De Traversée De La Rue Et Risques D’accident Chez Le Piéton

Résumé : La présente étude explore le rôle des compétences nécessaires à l’activité de traversée de la rue et leurs relations avec l’exposition aux risques d’accidents chez l’usager piéton. Cette activité s’apparente à une tâche de résolution de problème pour laquelle les piétons doivent utiliser des compétences spécifiques reconnu dans l’ensemble de la littérature dédiée à la question : « la perception du site de traversée, l’analyse de l’information routière, l’estimation du temps nécessaire à la traversée, et l’anticipation du comportement du conducteur. Un échantillon de 115 personnes (54 femmes, 61 hommes) ont répondu au test des Habilités comportementales de traversée de la rue (HCTR). Cet échantillon est composé de quatre sous groupes d’âges (G1: 18-30 ans ; G2: 31-40ans ; G3: 41-50 ans ; G4 : 51-60ans) et de niveau d’instruction fondamental, secondaire et universitaire. Les résultats montrent que les propriétés psychométriques du test sont acceptables. En revanche l’analyse des données montre l’existence d’une corrélation négative entre les compétences mesurées par le HCTR et le nombre de fois dans lesquelles le piéton a été victime d’accident (r=-0.30, p ≤ 0.01). La régression linéaire simple révèle que l’élévation du score dans le HCTR prédit la diminution des risques d’accidents des piétons (β = - 0,30, t = -3,29, p< 0,001). Le One way ANOVA montre que les scores du HCTR sont plus élevés chez le sous groupe de niveau d’instruction universitaire à comparer avec les deux autres niveau d’instruction ( F(2, 112)= 3.419, p= 0.036), cependant, aucune différence significative est révélée en fonction des variables tranche d’âge ( F(3, 111)= 2,071, p= ,108) et sexe (t= .69 , p= .49) Ces résultats montre que l’échelle des HCTR développée dans cette étude peut être mieux formulé afin de mesurer plus d’habilitées comportementales opérantes et sécurisantes chez les piétons. Par conséquent, cela implique que la sensibilisation dans le milieu socio-éducatif est la base d’acquisitions et d’assimilation des bonnes habilités comportementale pour diminuer les risques d’accidents. ملخص: تهدف هذه الدراسة إلى الكشف عن دور المهارات السلوكية في نشاط عبور الطريق وعلاقتها بالتعرض لحوادث الراجل. يعتبر هذا النشاط نوعا من حل المشكلات، ويستخدم الراجل مهارات محددة والمتمثلة في تصور عبور موقع، وتحليل معلومات عن حركة المرور، تقدير الوقت اللازم لعبور الطريق، وتوقع سلوك السائق. شملت عينة الدراسة 115 فردا (54 أنثى و 61 رجلا) و تراوحت أعمارهم بين 18 و 60 سنة. قسمت هذه العينة إلى أربع مجموعات فرعية حسب السن، وإلى ثلاث مجموعات حسب المستوى التعليمي (الأساسي والثانوي والجامعي). واستعمل سلم المهارات السلوكية لعبور الطريق، وتقدير عدد مرات تعرض الفرد للدهس حسب ما يقر به الفرد. أظهرت النتائج أن الخصائص السيكومترية للاختبار مقبولة. بينت نتائج تحليل التباين أن هناك علاقة سلبية بين درجة المهارات السلوكية وعدد المرات التي تعرض فيها الراجل لخطر الدهس (ر = -0.30،P ≤ 0.01) ) و بينت نتائج تحليل الانحدار الخطي أن المهارات السلوكية لعبور الطريق تنبئ بانخفاض خطر التعرض للدهس عند الراجلين (β=- 0.30 ، ت= - 3.29، دالة عند مستوى أقل من 0.001). كما أظهرت نتائج الدراسة وجود فروق تعزى للمستوى الثقافي وهي لصالح المجموعة الفرعية من ذوي التعليم الجامعي (ف (2، 112)= 3.419، قيمة الدلالة) ، بينما لا توجد فروق تعزى لمتغير السن (ف (3 ، 111)= 2.071، قيمة الدلالة قيمة الدلالة = 0.108) وكذلك حسب الجنس (ت= 0.69 ، قيمة الدلالة = 0.49). تبين هذه النتائج أن سلم المهارات السلوكية لعبور الطريق يمكنه تقدير هذه المهارات. لذلك، يمكن اعتماد محدداته في عملية التحسيس ونشر الوعي في البيئة الاجتماعية والتعليمية لاكتساب واستيعاب المهارات السلوكية الجيدة للحد من مخاطر تعرض الراجل للحوادث.
فلسفة العدالة الكونية عند جون راولز

الملخص: تعد العدالة فضيلة أخلاقية وقيمة اجتماعية تطمح إليها الشعوب والأمم، وبعض الأنظمة السياسية والاجتماعية، لهذا كانت محط اهتمام وبحث المفكرين والفلاسفة والعلماء، سواء علماء القانون أو الاجتماع أو السياسة، إن من حيث المفهوم أو المبادئ التي يجب أن تقوم عليها، ودورها في بناء المؤسسات الاجتماعية والسياسية، فهي أساس بنية المجتمع. ولقد حلم الإنسان بمجتمع تسود فيه العدالة والتي تقوم على المساواة في الحقوق والواجبات، ويزول فيه الظلم والتفاوت، فكان أن فكر الإنسان في بناء مجتمع ودولة أساسها العدل، فوضع نظريات وأفكار في كيفية بناء العدالة، وهو ما نجده لدى اليونان مع أفلاطون خاصة، وفي الفكر الإسلامي مع الفارابي، والمسيحي مع القديس أوغسطين، وصولا إلى فلاسفة التنوير أمثال روسو وهوبز. أما في الفلسفة المعاصرة فقد كان لنظريات الفيلسوف الأمريكي جون راولز صدى كبير على المجتمعات وعلى السياسات بما حملته من أفكار وتنظير جديد، وهوما دفعني لدراسة فلسفة العدالة الكونية عنده_أي جون راولز_ Abstract: Moral virtue is justice and aspiring social value to peoples and Nations, and certain political and social systems, that have been the focus of attention and consideration intellectuals, philosophers and scientists whether law scholars or social scientists or policy , the concept or the principles that must underlie, and their role in building social and political institutions, is the basis of the structure of society, and human dreams of society where justice prevails and which are based on equality of rights and duties, and where injustice and inequality disappear , human thought in a society and a State based on justice, development Theories and ideas on how to build justice is what we find in Greece with Plato, in Islamic thought with Al-Farabi, and Christian with St. Augustine, down to the philosophers of the enlightenment like Rousseau and Hobbes. In contemporary philosophy, the theories of the philosopher John Rawls echo on societies and on the policy as his campaign ideas and arthroscopy, which prompted me to study the philosophy of cosmic justice for him _ who is John Rawls _
Enhancing Citizenship Values In Secondary School English Textbooks

Abstract : In the wake of the educational reforms undertaken in 2003, the Algerian Ministry of National Education set out to make a new series of textbooks which are meant to reflect and comply with the requirements of the new curricula. The latter are largely underpinned by modern pedagogical dogmas and highly recommended values of the twenty first century such as: learner-centeredness, freedom and equal opportunity. The new set of textbooks, in all disciplines and across the grades, are supposed to attain harmoniously a host of political, ideological, cultural and learning objectives and aims. Within this perspective, it can be said that issues of identity and citizenship seem to be at the heart of textbook designers’ preoccupations. The common assumption is that citizenship education is by no means restricted to a well designed textbook of civic or Islamic education, but a shared objective of all schooling areas. Building on this ground, the present paper attempts to explore thoroughly the notion and values of citizenship in Secondary School Education textbooks which represent not only a material source for learning, but also a window through which students can get a few glimpses about the world. The study will be carried out through a critical and systematic analysis of the syllabi and contents of these course books with a special reference to the kinds of topics to which learners are exposed. The results and findings of the analysis will be used to suggest some recommendations to textbook writers and teachers in order to remedy the deficiencies and shortcomings of teaching citizenship values in a world that is exceptionally panicked by the threats of globalization. ملخص: في أعقاب الإصلاحات التربوية التي أجريت سنة 2003، أقدمت وزارة التربية الوطنية الجزائرية على تأليف سلسلة جديدة من الكتب المدرسية، بهدف التطابق ومقتضيات التوجيهات والمناهج المنبثقة عن الإصلاحات. وقد تم التركيز فيها على مقاربات بيداغوجية حديثة، تتماشى مع قيم القرن الحادي والعشرين، مثل: التمركزحول التلميذ، الحرية، تكافؤ الفرص. هذه المجموعة الجديدة من الكتب المدرسية، في جميع التخصصات وفي مختلف المستويات، كان من المفترض أن تتواءم مع مجموعة من الأهداف والقيم السياسية والاجتماعية والثقافية والتربوية والفكرية، ومن بين تلك الأهداف والقيم؛ قيمتا المواطنة والهوية، التين كانتا على رأس الأهداف المسطرة للكتب المدرسية. وإن التربية على قيم المواطنة ليست قاصرة - كما قد يعتقد - على كتب التربية المدنية والإسلامية، بل هي هدف عام مشترك بين كل المقررات الدراسية. تصبو هذه الورقة إلى استكشاف دقيق لمفهوم وقيم المواطنة في الكتب المدرسية لمادة الإنجليزية في التعليم الثانوي، والتي تمثل، ليس فقط مصدر المواد للتعلم، ولكن أيضا نوافذ ثقافية يمكن للطالب من خلالها الحصول على بضع لمحات حول العالم المعاصر. وسيتم تنفيذ الدراسة من خلال التحليل النقدي والمنهجي لمضامين هذه الكتب، مع التركيز بوجه خاص على نوعية الموضوعات والعناوين المعروضة للمتعلمين. توصلت الدراسة إلى جملة من النتائج العلمية، تم على ضوئها طرح مجموعة من الاقتراحات والتوصيات الموجهة بالخصوص إلى معدي الكتب والمقررات الدراسية، وللأساتذة كذلك، للمساهمة في علاج أوجه القصور والنقص الملحوظة في المناهج بخصوص قيم المواطنة، خاصة ونحن في عالم معاصر يهتم كثيرا بهذا المجال، كعامل أساس في مواجهة تحديات العولمة.

ملخص: التحكيم من أقدم الوسائل التي اتخذتها الأمم والشعوب والأفراد لحل النزاعات، وفصل الخصومات، وقد أثبت التحكيم جدواه وأثره حتى أصبح واقعا محترما لا تخلو دولة من تنظيمه. إلّا أنه وقع خلاف بين الفقهاء في صفته الإلزامية تجاه أطراف الخصومة، فاختلفوا في تحديد متى يمكن لأحد أطراف العقد أن يرجع عن عقد التحكيم بناء على اختلافهم في تكييف عقد التحكيم، الذي ألحق بالقضاء تارة، وبالصلح تارة أخرى. Résumé L’arbitrage est l’un des plus vieux moyens, prises par les nations, les peuples, est les individus; à résoudre les conflits, et détailler les déductions. Il a prouvé son utilité et son impact, jusqu’a ce qu’il devient une réalité respecté dons tout état de son organisation. ملامح الفكر الديني لإنسان الطاسيلي في المرحلة النيوليتية

الملخص: عرف الإنسان العبادة والدّين منذ القدم، فطبيعته البشرية تُشعره بالضّعف أمام الكائنات الأخرى، حيث اعتنق معتقدات ومارس بعض الشعائر الدينية وجسدها على أشكال مختلفة، فنجد مثلا الدلالات الأولية للحفريات المتعلقة بالفكر الديني للإنسان النيوليتي مجسدة في شكل رسومات على الصخور والكهوف باعتبارها الشكل الغالب الذي وصلنا ووضح لنا الرصيد الفكري والعقدي لإنسان ما قبل التاريخ. وتحتوي الصحراء الجزائرية الكثير من الملامح الأثرية التي تؤكّد العلاقة العميقة بين الإنسان والوسط الطبيعي الذي كان سائدا في الفترة النيوليتية، ولعلّ من بين هذه الملامح تلك النقوش والرسومات الصخرية المنتشرة في أرجاء الصحراء الجزائرية، خاصة بمنطقة الطاسيلي والأهقار والتي يرجع تاريخها إلى آلاف السنين، فجميع الدراسات التي تناولت موضوع النقوش والرسومات الصخرية تجمع على أن منطقة الطاسيلي مثلا كانت منذ القدم ملتقى الحضارات الإنسانية القديمة، بدليل وجود معالم أثرية تدلّ على استمرارية حضارية بالمنطقة، ويعود تاريخ الاستيطان البشري بها إلى حوالي 6000 ق.م (أي في العصر النيوليتي néolithique) (1) استنادا إلى تاريخ النقوش والرسومات الصخرية، وهذا ما جعلها مركزا رئيسا لحضارة كبيرة شملت الصحراء الوسطى وامتد إشعاعها إلى باقي أجزاء إفريقيا خلال فترة ما قبل التاريخ. ولأن الفن هو المعيار الرئيس لتطور المجتمعات كونه نتاج تفتُّق الذّهن البشري، فقد وظفه الإنسان في أولى محاولاته لتصوير حياته وفكره على جدران الكهوف والصخور بالنقش وهذا حال مختلف الرسومات بمنطقة الطاسيلي، وهنا يذهب بنا التساؤل عن ملامح الفكر الديني لهذا الإنسان من خلال مشاهد الرسوم الصخرية ومقارنة هذه المشاهد بذهنية الشعوب البدائية في عصرنا للحصول على نتائج في هذا الشأن، وهذا ما سنجيب عنه من خلال هذه الدراسة. Abstract Since ancient times, man knew worship and religion, It's the human nature that makes him feel weak in front of the other creators, they possessed many beliefs and practiced some religious rites then embodied it in different forms, for example, we find semantic preliminary excavations of religious thinking of Neolithic person embodied in the drawing forms on the rocks and caves as the dominant form that reached us and clarified the intellectual and religious quantities of the prehistoric man. The Algerian desert contains a lot of archaeological features that emphasizes the deep relationship between humans and the natural environment that prevailed in the Neolithic period, one of these features, the inscriptions and the painted rocks which is scattered across the Algerian desert, especially Tassili and Hogar which dated thousand years ago, for instance all the studies about the inscriptions and rock drawings that dealt with Tassili agreed that it was the meeting place of the ancient humanitarian civilizations, as an evidenced the presence of archaeological sites indicate the continuity of civilization in the region. The beginnings of the human settlement dated by 6000 BC. (ie, in the Neolithic period) based on the inscriptions and rock drawings history, therefore, this is what made it as a key to a great civilization, including the central Sahara, and its influence spread to other African parts during the prehistoric period. Because art is the main criterion for the development of societies as a result of taper the human mind, they used it in the first attempts to portray their life and thought on of cave's walls and rocks ,this is the situation of the various graphics Tassili's area, that’s why we are going to question about the features of religious thought of this man through the scenes of rock paintings and comparing these mentality scenes of primitive peoples with our modern time to get results under this regard, and this is what will answer through this study.
فاعلية المقاصد في الفقه الطبي

ملخص: جاء في طليعة البحث بيان مصطلحات مقاصد الشريعة والفقه الطبي، ثم تناولت ما يربط مقاصد الشريعة ومقاصد الطب في بيان العلاقة بينهما. ولما كانت مقاصد الشريعة ثلاث مراتب: الضروريات والحاجيات والتحسينيات قابلتها بالمسائل الطبية حسب مراتبها؛ فخصصت لكل مرتبة من مراتب مقاصد الشريعة مبحثا مع بيان أثرها في الفقه الطبي من خلال النماذج المختارة. Résumé: Mon article est basée sur la relation entre l’esprit du droit musulmane et la jurisprudence médicale, c’est a dire des positions du jurisprudence médicale. Après j’ais donné des définitions pour les concepts «l’esprit du droit musulmane» et « la jurisprudence médicale », après j’ais parlé sur la relation entre eut, et que l’esprit de la médecine se servir à l’esprit du droit musulmane dans le domaine de la médecine, chose qui peu donner à ce sujet une place importante dans la recherche lié a l’esprit des lois musulmane (MAKASID). Il y a trois classes des fins du droit musulman : les nécessités, les besoins, complémentaires, j’ais donné pour chacune d’elle des cas médicales et j’ais affecté une dissertation qui représente sons impact sur l’intention médicale à partir des exemples choisis.
الهوية الثقافية وصراع الحضارات في ظل الثورة التكنولوجية

ملخص: لقد أمسى الحفاظ على الهوية الثقافية هو الشغل الشاغل، ولاسيما في أعقاب أحداث الحادي عشر من سبتمبر التي شكلت ذروة صراع الحضارات آنذاك، وهو ما يدعمه رأي هانتنغتون القائل بأن الثقافة هدف يموت الإنسان لأجله. وباعتبار الدين عنصرا أساسا في البناء الثقافي فإن الاختلافات الثقافية هي ما يؤجج النزاعات الدولية التي ما تلبث أن تغدو صراعات حضارية ومن ثم صدامات. لقد تغيرت البنية الكونية بين الأمس واليوم، فبعد أن وسمتها ثنائية القطب إبان الحرب الباردة أعيد بناؤها مجددا وفق مفهومات ثقافية وحضارية جديدة رسمت بدورها ملامح السياسات الدولية وفق معالم الصراع الحديث، ذلك أن الخطوط الفاصلة بين الحضارات والثقافات ستغدو خطوطا لمعارك مستقبلية لتمهد بذلك الطريق أمام شكل جديد من أشكال النزاع في العالم الحديث. English: Protecting the cultural identity has become a very important matternowadays, particularly in the wake of the 9/11 attackswhich has been considered as the climax of whatwe call «the clash of civilisations », and according to Huntingtonidentityis something that a person wouldscarify his life to preserv. If we bear in mind that the religion is the most important component of the culture, we may understand how the international conflicts are stirred up. After being bipolar, the world has transformed to a multi civilizational world, what led to new references and new concepts and also new causes of wars based on the nuances between the cultures.
مناهج التصنيف في أصول الحديث ومصطلحه عند المحدثين

ملخص البحث: يهدف هذا البحث إلى إبراز مناهج علماء الحديث ونقَّاده؛ من خلال مصنفاتهم في أصول الحديـث ومصطلحه. وليس المقصود من هذا البحث حصر هذه المناهج والضوابط؛ بقدر ما أريد أن أبين أن هذه المناهج خاصة بدراية الحديث النبوي وليس بروايته، لأن التصنيف في الحديث رواية كانت بدايته مع جمع الحديث في عهد النبي r واستمر إلى أن جمع في مصنفات ومسانيد وكتب وجوامع وبطرق معينة. أما الكتابة في بيان مناهج المحدثين في أصول الحديث ومصطلحه ففي حدود علمي لم ُيتطرق إليه. لذا حاولت واجتهدت أن أبرز هذه الطرق بمختلف توجهات أصحابها. والله أعلم. Résumé: Cet article constitue le fruit d’une étude dans le domaine de sunna, qui vise à mettre en évidence les mécanismes et les procédures de recherche dans les idiomatiques et les techniques d’el-hadith chez les savants des sciences de Sunna.et dans la contre partie je n’ai pas l'intention dans cet article de démontrer les méthodes de collection d’el-hadith. Car cette tache réalisée par d’autres savants qui ont une expérience dans ce domaine, et c’était du temps du prophète Mohamed –que la paix soit sur luit- et dans le premier sujet je n’ai pas trouvé l’un des chercheurs qui a écrit dans ce domaine. Pour cette raison j’ai essayé de donner et d’exprimer ce type de travail. Enfin, il est évident que tout travail n’est jamais parfait, seulement avec la persévérance et le souci de bien faire on aboutira à parfaire toute œuvre.

الأصول التي بنى عليها ابن عبد البر آراءه واجتهاداته الفقهية من خلال كتابيه "الاستذكار" و"الكافي"

ملخص: يعتبر الإمام الحافظ أبو عمر يوسف بن عبد الله بن محمد بن عبد البر النمري القرطبي الأندلسي (368-463هـ) من علماء الأندلس الأفذاذ، الذين بلغوا درجة الاجتهاد، لإلمامه بعلوم القرآن وعلوم الحديث وتمكنه في فقه اللغة، إلى جانب اطلاعه الواسع على إجماع العلماء واختلافاتهم؛ فهو المجتهد المستقل الذي لايركن إلى التقليد ولا يتقيد بمذهب معين، بل يتّبع الدليل مع الإتقان والتحقيق، مخالفا في كثير من المسائل الفقهية آراء فقهاء المذاهب. واجتهاده هذا مبني على المصادر الأساسية للتشريع، وهي: الكتاب والسنة والقياس عليهما والإجماع وآثار الصحابة، ثم الأدلة التبعية، كالمصالح المرسلة والاستحسان والاستصحاب وسد الذرائع والعرف... وكل ذلك مدوّن في مصنفاته الفقهية كالاستذكار والكافي. وما عملنا هذا إلا تسليط للضوء على جانب من الجوانب العلمية التي نبغ فيها. Résumé: L'Imam Hafiz Abu Omar Youssef bin Abdullah bin Muhammad bin Abd al-Barr Nimri el-Andalousi (368-463) ,un des savants de l'Andalousie, qui ont atteint le degré de diligence, pour sa connaissance de la science Coran et du Sunna et de sa capacité de la langue arabe, ainsi que sa large documentation des consensus des scientifiques et de leurs différences, c était le savant indépendant dans ses opinions jurisprudence, Il ne suit pas une doctrine, mais il les preuves avec du perfection et d'enquête, contrairement à la plupart des questions de doctrine la vue des autres jurists . Cette diligence est basée sur des sources primaires de la législation, qui sont: le Coran et la Sunna, le mesurage, le consensus et les effets des compagnons puis les preuves secondaires, Kalmsaleh El-mourssala, El-istihssan, El-istishab et les coutumes... tout ça est blogué dans ses ouvrages de jurisprudence. Que faisons-nous seulement de nous éclairer sur le côté des aspects scientifiques qui excellaient.
مفهوم حقوق الإنسان وموقعه في الفكر الإسلامي المعاصر

ملخص: في تحديد مفهوم الحق عند فقهاء الشريعة، هناك ثلاثة اتجاهات رئيسة: الأول: أنه مصلحة ثابتة لصاحبه. الثاني: ما هو شرعه الله تعالى وأقره لعباده. الثالث: علاقة اختصاص بين صاحب الحق ومحله. وقد قسموه إلى قسمين رئيسين هما: حق الله، وحق العباد... أما حقوق الإنسان في الاصطلاح المعاصر فتعني: مجموعة الحقوق والمطالب التي يجب الوفاء بها لكل البشر على قدم المساواة، دونما تمييز فيما بينهم. أما موقع حقوق الإنسان في الفقه الإسلامي؛ فلا نجد بابا خاصا في كتب الفقه الإسلامي مختصا بحقوق الإنسان، ذلك أن الشريعة قد اهتمت بمعالجة كل حق في موضعه من الباب الفقهي الذي يتعلق به، وهناك من المعاصرين من دعا الى تخصيص باب مستقل لحقوق الإنسان. أما موقف المفكرين المسلمين تجاه الميثاق العالمي لحقوق الإنسان فيتلخص في التذكير بأسبقية الدين الإسلامي في تقرير حقوق الإنسان، مع التأكيد على الخصوصية الثقافية للعالم الإسلامي، ونقد ازدواجية المعايير في التنفيذ. Summary The notion of ‘Right’ in the Islamic jurisprudence can be concluded on three concepts: 1- The Right is a permanent benefit to its owner. 2- The Right is legislated by God. 3- The specific relation between the owner of the Right and its subject. The Right is divided into two main parts: God’s Right and Human Right. The Human Rights in the modern concept means: the total rights and needs which must be -equally- offered to every person, without any separation. We didn’t find a special chapter to Human Rights in jurisprudence books, because they used to detail each Right in its subject. Thus, the modern scholars claimed to specialize a new chapter to human Rights. The Islamic point of view about the world charter for human rights focussed on reminding the precedence of Islamic religion in deciding the Rights, confirming the specify of Islamic culture, and criticizing the duality of the practical standards.
حقائق مخفية حول الإسلام والمسلمين في إفريقيا

ملخص: هذا المقال هو محاولة لتوضيح عدة حقائق مجهولة حول الإسلام والمسلمين في إفريقيا، أدى عدم وضوحها إلى انتشار معلومات خاطئة عنها على نطاق واسع. وقد تناول المقال بالتوضيح ما يلي: ـ بطلان دعوى أن الأوربيين هم من استكشف قارة إفريقيا، وبيان أن المسلمين قد سبقوهم إلى ذلك بقرون عديدة، تصل في بعض المناطق إلى خمسة قرون، باعتبار أن المسلمين قد توغلوا في القارة ابتداء من القرن الرابع الهجري؛ العاشر الميلادي، وأما البرتغاليون وهم أول من غزا القارة من الغربيين، فلم يصلوا إلى وسط القارة إلا في القرن الخامس عشر الميلادي. - بيان الطرق التي وصل بها الإسلام إلى إفريقيا جنوب الصحراء، وأنها من المناطق التي وصلها الإسلام دون حروب، وإنما وصلها عن طريق أخلاق التجار والدعاة إلى الله، وأنها في ذلك مثل جنوب شرق آسيا التي يشير إليها الباحثون دائما ولا يذكرون إفريقيا إلا ما ندر. - بيان دور المسلمين في تنمية القارة، وإقامة دول وحضارات على أراضيهم شهد الكل بتقدمها ورقيها. - إبراز صورة مقاومة المسلمين للاستعمار الأوربي، وبيان الجهد الكبير الذي قاموا به في سبيل صد موجات الاستعمار التي غزت القارة. - تبيين حقائق حول أعداد المسلمين في القارة، وكشف محاولة بعض الباحثين الغربيين، لأغراض غير نزيهة، تقليل عددهم بصورة متعمدة. Résumé: Cet article est une tentative de clarifier plusieurs vérités inconnues sur l'Islam et les musulmans en Afrique, qui a poussé son ignorance à certaine information incorrecte de se propager à longue durée. Cet article nous montre que: Les européens n'ont jamais découvert l'Afrique les premiers mais les musulmans les ont précédés de plusieurs siècles et certaines places, ils les ont précédés de cinq siècles, considérant que les musulmans ont entré en Afrique le début du 10ème siècle. Les portugais sont les premier qui ont conquérez l'Afrique parmi les européens, ils sont arrivés eu Afrique au 15ème siècle. Montrer comment l'Islam est arrivée Afrique au sud du Sahara, et qu'il est arrivé sans guerre mais avec la moralité des commerçants musulmans, et les invités à la générosité de l'Islam, comme le sud-est de l'Asie qu'on en parle toujours oubliant l'Afrique. Montrer le rôle important des musulmans dans le développement du continent, et l'institution des pays civilisés et modernes. Faire sortir l'image de la résistance islamique contre le colonialisme européen, et montrer que les musulmans africains ont eu un grand rôle dans cette résistance. Donner des informations véridique du pourcentage des musulmans en Afrique, et révéler la tentative de quelques érudits occidentaux pour la réduction déloyale du nombre des musulmans en Afrique pour des raisons malhonnêtes et donner des faux pourcentages; Délibérément.
