    الموقف الاستشراقي من حق المرأة في الميراث

    ملخص بحث: الموقف الاستشراقي من حق المرأة في الميراث اتخذ عدد من المستشرقين من دعوى الدفاع عن حقوق المرأة مطية للطعن في عدالة الشريعة الإسلامية وتشويه محاسنها ، ناقمين على ما يخص المرأة المسلمة من أحكام شرعية كأحكام الميراث،. ومع أن هذا العداء والتشويه هو الأصل في كتابات الكثير من المستشرقين، إلا أن طائفة منهم أقرت بالحق وصرحت به، فأعلنت إفلاس الحضارة الغربية في حفظ حقوق المرأة وصيانة عفافها، وأقرت بتميُّز الشريعة الإسلامية في إكرام المرأة وحفظ حقوقها، وسأعمل على إبراز تلك المواقف المعتدلة امتثالاً لأمر الله تعالى بالعدل حتى مع المخالفين، وستكون هذه الكلمات الغربية المعتدلة حجةً على الجاحدين لعدل الشريعة الإسلامية، من المستشرقين ومن تابعهم. وقد خصصت هذا البحث لمناقشة موقف المستشرقين من حق المرأة في الميراث مبيناً ماكفلته الشريعة الإسلامية للمرأة من حقوق مالية والحالات التي يكون نصيب المرأة في الميراث أكثر من نصيب الرجل أو مساوية له والحالة التي يكون للرجل أكثر من نصيب المرأة والحكمة من ذلك ، وقد قسمتُ هذا البحث إلى تمهيد وعدد من المطالب على النحو الآتي: تمهيد: التعريف بالاستشراق المطلب الأول: الموقف الاستشراقي من حق المرأة في الميراث المطلب الثاني: ميراث المرأة في الجاهلية المطلب الثالث: الميراث في اليهودية والنصرانية المطلب الرابع : الحكمة من زيادة نصيب الرجل على المرأة المطلب الخامس: حالات زيادة نصيب الرجل للمرأة في الميراث أو التساوي معها المطلب السادس : مواقف غربية منصفة حول حقوق المرأة المالية أ.د. محمد بن سعيد السرحاني أستاذ الثقافة والدراسات الاستشراقية في قسم الدعوة والثقافة الإسلامية جامعة أم القرى Abstract Orientalist Attitude towards Women's Inheritance Rights Some orientalists took the case to defend the rights of women as a means to challenge the justice of Islamic law and distort its advantages, criticizing the legal provisions regarding Muslim women, such as inheritance provisions. Although this hostility and distortion is the root of the writings of many orientalists, a group of them recognized the right and stated it, declaring the bankruptcy of Western civilization in preserving women's rights and preserving their chastity, and recognized the distinction of Islamic law in honoring women rights and chastity. The research highlights these moderate positions, as God commands us to deal using justice even with violators, and these moderate Western words will be an argument for the ungrateful to the justice of Islamic law, including the Orientalists and their followers. This research discusses the orientalists attitude towards the right of women regarding inheritance, stating what Islamic Sharia has guaranteed to women including financial rights, and cases in which the woman’s share in the inheritance is more than or equal to that of the man, and the situation in which the man has more than the woman’s share and the wisdom behind that. This research consists of a preface and a number of topics as follows: the Preface: Definition of Orientalism Topic one: The Orientalist attitude towards the right of women in inheritance Topic two: The inheritance of women in Pre-Islamic Era Topic Three: Inheritance in Judaism and Christianity Topic four: The wisdom of increasing a man's share over a woman Topic Five: Cases of increasing a man’s inheritance over a woman’s inheritance and cases of equality Topic six: Fair Western attitudes towards women's financial rights Prof. Muhammad bin Saeed Al-Sarhani, Professor of Culture and Orientalism, Department of Islamic Da'wa and Culture, Umm Al-Qura University
