اعتبار المآل وأثره في الاختيار والترجيح الفقهيين (دراسة نظرية تطبيقية)

Abstract

تهدف هذه الورقة البحثية إلى بيان أهمية الاستفادة من أصل اعتبار المآل عند النظر في الأقوال الفقهية الخلافية، مع إبراز أثر وتأثير هذا الأصل في الاختيار بين تلك الأقوال والترجيح بينها بما يواكب روح العصر وواقع الناس، ويرفع الضيق والحرج عن المكلف، ويحقق مقاصد الشريعة. ولقد خلُصت الدراسة إلى أن التراث الفقهي الإسلامي حافل بالاجتهادات والآراء الفقهية القابلة للتكيف مع الواقع والمتوقع؛ ودراسة تلك الاجتهادات والأقوال تقتضي إمعان النظر في كل قول فقهي ، واعتبار ما سيؤول إليه من تداعيات ونتائج؛ ومن ثَمَّ إعماله أو إهماله؛ فقد يكون ظاهر القول راجحًا وفيه مصلحة ؛ لكن عند التمحيص والتدقيق نجد أن اختياره وترجيحه يؤدي إلى نتائج وآثار تخالف المقصد العام من تشريع الأحكام وهو جلب المصلحة ودرء المفسدة. Abstract: This research paper aims to demonstrate the importance of making use of the origin of the consideration of fate when considering controversial jurisprudential statements, highlighting the impact and influence of this asset on the choice between those sayings and the preference between them In accordance with the spirit of the times and the reality of the people, and lifting the distress and embarrassment from the one charged with, and achieving the purposes of Sharia The study concluded that the Islamic jurisprudential heritage is full of independent reasoning and Juristic opinions that are adaptable to reality and the expected; the study of those independent reasoning and sayings require careful consideration of every jurisprudence; and considering what it becomes with repercussions and results. And then realizating or neglecting it, the apparent saying may be successful and has an interest. However, but through examination and scrutiny, we find that its choice and preference lead to results and effects contradicting the overall purpose of legislation provisions,It is to bring interest and prevent corruption
